A friend has been here for four years, adjusted status, but has recently been placed out of work with a young child, and has found it very difficult to make ends meet. She left her husband because it became apparent to her that he was beginning to abuse the child. I have to believe there was at some point, an affidavit of support submitted on her behalf by her husband whom she is now making arrangements to divorce. She has no copies of any documents with the exception of being in possesion of her green card and passport. In seeing how almost destitute she is, I would like to advise her in how to receive the support her husband promised in the affidavit. However at this point I have no idea how to advise her. Does anyone have any ideas or information that i can provide her to guide her to those who can assist her and possibly enforce the I-84 if there was one? I have gone through the immigration process bringing my wife here, but we have always placed importance in maintaining our documents. Unfortunately, she had to leave with no assistance. Any information would be helpful. Thankyou.

Yes, an I-864 was signed but it's intent is really to reimburse the taxpayer for means tested benefits the immigrant might receive. Some family law judges have used it to issue support orders to US Citizen spouses but it is rare. You can download the I-864 and read it, then show it to her divorce lawyer and see what happens. If she has a green card, that's all the evidence required to know her husband signed an I-864. Can't get a green card without it.

Yes, an I-864 was signed but it's intent is really to reimburse the taxpayer for means tested benefits the immigrant might receive. Some family law judges have used it to issue support orders to US Citizen spouses but it is rare. You can download the I-864 and read it, then show it to her divorce lawyer and see what happens. If she has a green card, that's all the evidence required to know her husband signed an I-864. Can't get a green card without it.
