seriously, how long is the wait??

i am going to send in my application for the k-1 next week, im still getting the paperwork done.

do i need a lawyer?

about how long is the wait? my fiance is in Honduras. i am in Florida. i cannot wait too long! i know someone who is from honduras and it took her 8 months to go to Oregon to her husband! i will probably visit my fiance in June but i need him here now! i want to start our lives together now and the distance is killing me!

so my question overall is how long do you think i should expect? and should i get a lawyer?

if all else fails and the wait is too long he asked me to move with him in Honduras and i must say, if the wait is more than a year i will say goodbye to the united states :(

is there a difference in months you file the petition?

The wait is seriously no less than 6 months, and probably closer to 10 months from start to finish. Take a look at the Honduras forums and find folks applying for the same paperwork as you and check it out.

You don't *need* a lawyer. The paperwork might feel overwhelming but if you're paying attention and willing to put the work in, you can complete it yourself/together. We got a lawyer because we didn't want to pay (in money or time) if we screwed something up the first time, and we still managed to screw something up. It was very minor, but I honestly feel better knowing he's done this before and is calling around to get us through this as fast as possible.

February 3, 2011 - application sent from NVC to Montreal (aka. the Abyss?)

March 7, 2011 - Packet 3 sent to me

March 10, 2011 - Packet 3 delivered to Montreal

March 21, 2011 - Packet 4 sent to me

April 5, 2011 - Medical

April 13, 2011 - Interview - approved!

April 20, 2011 - visa in hand

May 9, 2011 - POE (Buffalo, NY)

May 10, 2011 - wedding :)

u don't *need* a lawyer. The paperwork might feel overwhelming but if you're paying attention and willing to put the work in, you can complete it yourself/together.

Best of luck!!!! you do not "need a lawyer"

The waiting varies, but I will say that my cousin did the k1 for his then fiance in Honduras, and it only took him 4 months overall!!! Best of luck, but be prepared to wait!!!

We considered the same thing since 5-10 months feels like an eternity away from your loved one.

One thing you may want to think about is that even if you move to Honduras, at some point if you want your fiance to be able to come to the US (for whatever reason, even to visit) you'll need to wait for some kind of visa process. We decided that if we were going to have to deal with the USCIS, either now or sometime down the road, we might as well get it over with now. The process is overwhelming but everyone here has to go through it, so you're certainly not alone. I think we're all waiting impatiently :P

A lawyer wont make the process go any faster. A Lawyer is good in cases that may have red-flags, or is good for situations dealing with a denial.

I do not agree. I personally know 3 people who have done the k1 visa in less than 6 months (tops, 5 months), and with the help of their congressman in particular with one case, their fiance arrived in less than FOUR MONTHS. It depends on the country, how good your file is, and who happens to look at it at USCIS.

Do not trust that your case will be completed quickly as other members have said (6 months or less). Yes, you could be the lucky one, but what if you aren't? For instance, look at me! I am still waiting for NOA2 and I'm quickly approaching the 5 month mark since my petition was received by CSC. There is also no way to know when my fiance will get his cita or if he will even be approved! This is a nerve wrecking, expensive, and time consuming process. There are NO guarantees (with a lawyer or without one). If you cannot wait for the process to take as long as a year (it has actually taken longer for some VJ members), then seriously consider saving yourself the petition money and moving to Honduras. Though you can get many more lempiras with US$1, but at least you would have punta music to dance to with your loved one even if you did not have much money or comforts...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I would not hire a lawyer if you don't have anything to use him for, mine screwed up so far cost me at least 8 weeks that I know of! You could use a service like blossoms.com to the all the paperwork for you for a fee of like $650.00. They put the whole package together for you put colored tabs where you need to sign the forms. I used them before I thought they did a god job. They can only use what you give them so front load the heck out it. Pictures emails, plane tickets boarding passes hotel receipts.
