More than 4 months since AOS filed

It has been greater then 4.5 months since I filed my AOS (4 months is the processing time for AOS based on family visas/K-1).

When I called the USCIS yesterday, the lady asked if there was any action taken on my case or an RFE. I said no RFE but biometrics was done.

So she said oh ok, biometrics is considered an action on the case (which i strongly believe is not)

She said that I have to wait 60 days after my biometrics before they can initiate an inquiry. She asked when my biometrics was so I told her 'around' Nov 20th. I asked her what was the exact day of biometrics and she said she has no way of finding out. So in reply I asked her that I could have easily told her October 20th and would she have believed me?

Then she FINALLY, got off her 'script' saying she doesn't want to get into the semantics..

Can anyone confirm the validity to the statement that we have to wait an additional 60 days after biometrics to initiate an inquiry?

I know the script is a joke hey they go through the whole speel and you have to wait for them to finish before they start talking human. lol So if it is 4.5 months that means you sent off AOS in September? You should have received your Bio appointment sooner than November. I received my appointment 4 weeks after mmm I would wait till the 20th December which is 2 weeks and then ring again. 60 days crazy I know you should know by now about your AOS. Keep on them I say

Biometrics IS an action on your case because, you did something to your case, hence the term "action". Just like an RFE is an action, you responding to an RFE is an action.. basically you updated your case by doing biometrics.

Aside from that no I can't tell you if you need to wait 60 days. Call the number again and ask to speak to an immigration officer (they HAVE to put you through if you ask). The person you spoke to WASN'T an immigration officer, they were just someone given a script. Ask the immigration officer what you need to do. Maybe you'll need to make an infopass appointment.

Have you been watching the filers group for your month to see if anyone else is still waiting?
