Its possible they could deny you, especially with the way VWP is at the moment, but I would do my best not to worry if I was you. If you want some more info, pay for an hours consultation with a GOOD immigration lawyer who is up to date on the current situations (i paid about $80 for a phone consult).

I may be wrong, but I don't believe commenter is here on VWP, I believe they are here on a B2 - according to their avatar they are from Uruguay which I'm pretty certain is not a VWP country. The OP is contemplating AOS from a B2 from Armenia, so also not VWP. Either way, I don't think there's a risk of denial based on the visa they are adjusting from.

I'm not at all knowledgeable on this, but from what I understand so long as you don't overstay (or overstay by more than 180 days?) since they stamp the date they receive your first filing you are within law.

That's right. That is why the date of her return flight is unimportant insofar as "overstay". Any overstay is determined by the exit date stamped on her I94.

Personally though I would not stay past that airline departure date without a marriage. But that's just me.

First off sorry for resurrecting this old topic. We went with sending the I-130 + I-485 thing, we're pretty confident, and we're loving the whole happily ever after thing :->

One new question for which I searched and found conflicting info: do we apply for a social security card or does USCIS arrange to mail us that without any further action from our side?

You apply for the SSN number once you have the EAD. Go to the website of the Social Security Administration (www.ssa.gov), download the application, and go to the nearest SSA office in your city. It will take 2-3 weeks to get the actual card.

Hi there,

I am turning to you guys with a question - we have filed our i-130, i-485, the application for the EAD and for advance parole on 28th of March and as to the tracking records they are in an initial review process. We are wondering when will we recive the biometrics notice and other dates you have experienced, please. Just want to make sure how long the waiting will take:)

Depends on your field office and how long the wait is there. It can be next week, it can be in two months (we waited two months for the notice, ours was backed up.) You can check similar timelines to see how long people in your area have been waiting.
