Hello everyone, I would really appreciate some advice on this.

I filed I129F back in June with the great info on this site. Well on November 17, I received form I-797 saying my application was approved. This is where my confusion starts. Is the I-797 considered the NOA2? I was under the impression that after that notice your application got sent to the National Visa Center(NVC). Well its been a little over a month(5 weeks) and the NVC hasn't received my application. The letter says that the application was sent to the listed consulate which is in El Bajio Guanajuato, Mexico. As I understand it that consulate is an VPP(Virtual Presence Post), which I'm not sure if they handle K1 visas. Which makes me think that my file got sent to the wrong place.

So I guess my question is what should I do? if anything. Should I wait a little longer? Who should I contact?

Any help would be greatly appreciated.

Hi, I-797 is NOA1 your at the 5 months so you sould be receiving NOA2 soon, after NOA2 you they will send it to NVC..Good Luck :)

I was wrong, I-797C is NOA1, that means you DID get your NOA2 . You should hear from them soon, if not call

They can use an I-797 as notice of anything they want. If the notice said the petition was approved, then it was approved. You can never get any information about a K visa case from the NVC automated system. You MUST speak to a human.

The case will be sent to Juarez, like all family based visa cases for Mexico.

thanks for the help. Should I call the NVC, the consulate, or USCIS? To me it just seems odd that it was forwarded to a VPP consulate rather than the NVC first. Also when I check my case status online it still shows under "Initial Review".

@pushbrk- Yeah I was expecting it getting sent to Juarez. I will call the NVC fisrt thing tomorrow as they seem to closed today due to snow, at least that's what there automated system says.

In the odd event when a case gets sent by NVC to a wrong or non-standard consulate, that consulate will virtually always realize the error and forward it on to the right place. This has happened in Canada in a couple of recent cases, one where a case that was supposed to go to Vancouver [because the beneficiary lived in Western Canada] went to Montreal, and one where an I-129F was marked by the petitioner to go to Toronto [who don't even process family visas].

I'm sure El Bajio Guanajuato will transfer it to Juarez within a few weeks. If a month or two go by with no Packet 3 [assuming Juarez normally mail out Packet 3's], you should probably call the NVC or Juarez to follow up on it.
