Another question, will it affect our K1 application if my fiance is not working in his country . . . he's from the UK and due to his circumstances there, he qualifies for benefits that support him and his daughter. Also, will our ages be a problem . . . I'm 37 and he's 48. We've known each other for 6 1/2 years but have finally decided to make this all permanent.

The person in question the OP is asking about is the beneficiary.... FWIW, the beneficiary working is not a requirement

YMMV

As long as you making at least 125% of the the poverty guidelines for your household size, you should be fine. Here's a link to the 2010 guidelines: http://www.uscis.gov...form/i-864p.pdf The beneficiary's income or lack thereof doesn't normally factor in the situation since it tends to cease, at least temporarily, when they move from their home country to the US.

The age difference should not be a factor at all. Especially since the difference is not at all extreme considering your relative ages.

Consulates usually follow local cultural trends when it comes to visa application decision-making. If it's considered socially taboo to have a much older woman than man in a marriage, then they look at relationships where this is the case more closely. Or, as I saw someone whose beneficiary was in China advising recently, only 1 meeting will not cut it at interview. True if you're in China, but not if you're in the UK (as the person being advised was).

When reading advice that relates to anything interview related, always check the beneficiary's country. If other than yours, cross check with your country's practice and procedures. Often a very different kettle of fish.

Timeline Summary:

K-1/K-2 NOA1 - POE: 9 February - 9 July 2010

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017

Thanks everyone . . . I just read somewhere once that they didn't like big age differences (even though we don't consider it big!) and they don't like older couples . . . that it gets harder if you are close to 50.

The consulate does not nor will they ever officially document a refusal decision for a visa because of age, as that would be age discrimination.

YMMV

If a personal experience will make you feel better....

We're UK, over 50, and 10 years difference in age. We've zipped through each part of the process from K1 to greencard with no problems or RFEs. London is easy when you get to that part of the process.

I was 47 and the husband was 41 when we went through London.

Our journey together on this earth has come to an end.

I will see you one day again, my love.
