Timeline

If I'm unemployed can I still bring my gf over to the usa? Can I use my mom to sponsor her even though I have no income? My mom has a job for her lined up because she works as a nurse and my mom is in the same field and helps run the company. I plan to visit my gf soon within the next couple of months. I'm capable of doing work and I make money raking leaves or snow but no steady work just yet. Can we get the visa for me to marry her and my mom as the sponsor til I get a job?

Can I marry her and have my mom sponsor her though? Even though I don't have a job?

As long as your mothers income is above the I-864 poverty guidelines for the household number she can co-sponsor. You still have to file the I-134 along with her.

If you're engaged then get used to calling her your fiancee, and not your girlfriend. The difference is critical to the US government. The fiancee of a US citizen is eligible to apply for a visa to come to the US and marry the US citizen. The girlfriend of a US citizen is not.

Your mom cannot sponsor her instead of you. You're sending the petition, so you will be the primary sponsor. However, your mom may be able to sponsor her in addition to you. This is called a "joint sponsor". It depends on the consulate. Some consulates rarely accept joint sponsors for a K visa.

After your fiancee comes to the US and marries you then she'll need to submit an application for a green card. You'll have to submit another affidavit of support at that time. If your income still isn't enough then you'll need a joint sponsor again. The I-864 affidavit of support you submit with a green card application is not like the I-134 you send to the consulate. The I-864 is a legally binding contract which you and your joint sponsor could be stuck with for a long time - even if you eventually get divorced. Make sure your mom understands what she's getting into.

I just say gf because although we want to get married and she already told me yes. The ring isn't officially on her finger yet. Although I do have her a ring already.
