Hello,

I was born in Cuba (1986) and moved to the Cayman Islands in 1995 were I became a resident there in 2001, but in 2009 I came to Los Angeles, CA as an international student from the Cayman Islands on an F-1 Visa.

Having been here in Los Angeles, CA since August 3rd, 2009 as an international student at a community college here, I'm now wishing to change my status from F-1 International Student to that of a permanent resident in order to work because I just had a kid (little daughter) here in LA.

My question is, will there be any problem for me If I apply for permanent residence trow the Cuban Adjusmtnet Act ?

Hello,

Unless there's something you've neglected to tell us about, like a conviction for a crime that would make you inadmissible, you should be able to adjust status and become a permanent resident. The requirements are pretty straightforward:

1. A Cuban national or citizen.

2. Present in the US for 1 year.

3. Admitted or paroled into the US.

4. Not inadmissible.

Re. #4, most inadmissibilities have to do with health or criminal problems.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

No problem at all since you're here for more then one year.I'm doing the same:)

The only requirement is legal entry,proof of one year presence and proof of Cuban citizenship(I used my passport but they accept birth certificate,Cuban identity card or any proof that at least one of your parent is cuban-of course passport is the best).

It doesn't say it on uscis website but when you apply do not forget to send the police clearance for any county(NOT country) where you lived for more than 6 months!
