Okay ... like the topic says my finance will be ocming to DFW with a tourist visa and we would like to know what is the best method of applying for greencard/permnanet resident. I dont know exactly where to post this but originally we were going to get married overseas and apply for a K3 visa but now that she was able to get a tourist visa we are planning on getting married in USA and getting a marriage license and the whole 9 yards. Any Advice or Guide links would be greatly appreciated!

Entering on a tourist visa with intend to immigrate is FRAUD. DO NOT DO IT.

Do things the proper way, marry then your fiance leaves and you apply for a CR-1.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

inky: sorry she doesn't plan to immigrate right now ... she is going back to Australia and continuing her job because she is only coming for 2 weeks and i wans't planning on applying for anything until after she leaves. Is this still fraud? or is this legit now? If she leaves on her own after 2 weeks (which she plans on doing) do i still apply for CR-1? or something else??

Yes if she leaves after her vacation it is fine, you file for the CR-1 spousal visa after your married. The K-3 doesnt exist anymore, CR-1 will save you a little money and she does not have to do anything to get the green card, it will come in the mail after she moves to the USA on her CR-1 visa.

Its suggested that your reframe from any tour Visa visit.

They will look for the possibly that your trying to bring her

iin to the USA to get around the CR-1 or K-1 Visa process.

Not a good idea, as they have in place rules regarding people

trying to go around the process. It will hurt her chances later.

Better to play it safe and dont ruin your chances later to try

this. It just a word of warning. But you can do what you want.

but dont say we didnt tell you first.

Good Luck think twice before you do some thing you regret later.

If you marry than do a CR-1 Visa, if your going to bring her not married here

than do a K-1 Visa

At the top of the page you will find the link to the Guides. I'm going to move your thread from the K-3 forum over to the IR-1/CR-1 forum, as the K-3 visa is dead. You will also want to visit your regional forum for information specific to your fiancée's Consulate and country. Here, also, is a link to the Visitation FAQ's to guard against denial of entry. It specifically mentions K-1 applicants but is applicable to all.

Its fine to marry on a tourist visa, its just not okay to immigrate on one. If youre worried, just bring proof of her job/rent etc back in Australia as well as the return ticket!

30/01/12: Interview @ 9am [APPROVED!!]
