CR-1/K-3 predicament

I submitted an I-130 petition with the intention of following up with an I-129G petition toward a K-3 visa. At the time, I was under the impression that the K-3 route was quicker. Apparently processing improvements have made the CR-1 route quicker and the K-3 has become obsolete.

Because of my original intention, however, on the G325a biographical I submitted with my I-130 petition, in answer to the question "This form is submitted in connection with an application for," I checked "Other" (rather than "Status as a permanent resident") with an explanation that I will apply for a K-3 visa. Is it possible now to inform the USCIS that I would like to pursue the CR-1 and abandon the K-3 visa? Or, is the die already cast and I should submit the I-129F in pursuit of the K-3?

I posted a similar thread previously, but the answer I now require was not suggested and the thread died. Here I'm giving it another try.

Thanks,

Andrew

I don't think it will matter.

You can call USCIS to put your mind at ease but they are useless and can't do anything anyway

good luck

I should add that my concern is that if I do nothing, the USCIS, expecting my I-129F petition, will not process my I-130 petition. Perhaps I'm being overcautious, but I don't want to take any chances.

No worries. They'll proceed with the I-130.

Your petition will be put into a line and wait to be adjudicated. No one has even looked at your petition yet and they won't until an adjudicator picks it up to review it. When he/she does, they will note that there is no I-129F petition and likely assume that you changed your mind and did not file the I-129F. There is no law against changing your mind

Again, NO ONE has reviewed your case, no one is putting your I-130 on hold waiting for more information

Good luck

Not to worry about this, also be aware NVC also offers an improved electronic process for China.
