Hello VJRS,

I would like to ask how is current sustained income evaluated?is it based on the amount earned or it is based on the stability of the job or income?

Does the contract worker even earning above poverty guideline ,will not be able to sponsor even if his current contract is earning above the poverty guideline? is he not capable to be sponsor due to his job stability.Please to anyone who has idea in this help me,im so confused..thank you.

It has to do with current total income. Nothing to do with stability.

They will evaluate everything you give them but if you are a "self-employed" contract worker instead of an "employee", your current income is from line 22 of your most recent tax return. Simply showing you have a contract now and the revenue from it is not likely to be enough.

We would need more details to give any more meaningful assessment of your qualifications.

They will evaluate everything you give them but if you are a "self-employed" contract worker instead of an "employee", your current income is from line 22 of your most recent tax return. Simply showing you have a contract now and the revenue from it is not likely to be enough.

We would need more details to give any more meaningful assessment of your qualifications.

Thank you inky and pushbrk. My fiance income last year 2009 is short of 3000 from poverty guideline for the household of 2 it was due to recession . He has regular permanent job early this year2010 but not paid much and in september15,2010 he was a contracted to be a chef in the company,it is a 2 year contract and every month he will be paid 3000 for his service. all cooking tools and ingredients for food preparation,transportation expenses,room and board are provided by the company.His boss told him that his probability of continuing service and get permanent in the position is very good. Will he be able to sponsor me? My interview will be this january 2011..will he quit this nice job and find regular job? Please help me.. thank you so much

If he can show the contract, that would be good. Is he an "employee" or a self employed contractor? Ask him. He'll know. Either way, I would state the income as $36,000 and document it with the contract and evidence of actually receiving the money.

He was a contract labor as what it is shown in his pay stubs.he has pay stubs only 3000 monthy but not 36,000.

The company will just write down he was hired as chef of the company for a of 2 year contract starting september 15,2010.and he will be receiving 3000 monthly for service rendered.all tools and equipments as well as ingredients needed for food preparation,room and board,transportation expenses are provided by the company.his probability of continuing his service is very good.It will be signed by the manager of the company and letter head stationary of the company and will be notarize by the atty. will this be enough as contract? what else we need?will this contract labor he has now recently will show that i will not be a public charge? thank you so much

A two-year contract is pretty good job security, really. In the "current annual income" box write his expected income for the coming year. When it comes time to submit the evidence, you should have all his recent pay stubs, so from when he started this job up to the interview date or as near as possible.

i have a question. on the I-864 it asks the total income. Do we write the total income BEFORE or AFTER tax? GROSS PAY OR NET PAY? im confused

Again, it matters if he is an "employee" or "self-employed" Ask him that question. If he doesn't understand, ask him if he expects a W2 form from the place he's working. It's still not clear to me because you haven't answered the actual question. It's not a matter of what somebody will "write". I need the actual facts.

pushbrk he was a self employed contract laborer.he will be having 1099 and not W2 form from the place he was hired recently as a chef..,His boss will write a letter that he will be paid 3000 monthly as it is shown in his 4 pay checks.Boss will also state that he is full time chef in the company for 2 years starting september 15,2010-septmeber 15,2012..His probability of continuing service to the company is very good..will this be ok ?
