Hello All,

Filing the K1 visa petition- Employment ???

Back ground info,

52 yrs old, Moved to France 1992 until 2008. Moved back to USA 2008 to present -unemployed.

Have never asked for government assistance.

Have not filed taxes in USA since 1992.

Question: Concerning "employment" How best to fill in the forms? What to do for smooth processing?

Note, we are not destitute, have money in the bank, a sponsor if needed and employment lined up for next year.

You will need a co sponsor for sure. As far as the forms, just put that you are unemployed.. The issue of future employment can be addressed during the interview by your fiancee if they ask (provide her with proof of your future employment).. List any previous jobs that you held while in France on the forms where it asks about past employment, just like you would if they were jobs in America.. You can provide them with bank statements, but I doubt they will make up for lack of any tax returns. Get your co sponsor ready ;)

K1s and co-sponsors, historically speaking, do not mix well at the embassy in Bangkok. You may want to consider marrying first and going the CR1 route unless you don't mind possibly throwing away your money on a K1 only to have it rejected. Another option is to find a job that will eliminate the need for a cosponsor which may help.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

Co sponsors are not allowed in most K 1 cases in Thailand. I doubt they will ask her about your future employment but if you have a employment offer she could submit the letter just prior to the intervew. The decision will hinge on the support & tax issues.

You should also write to explain your tax situation. They will require something before any visa is issued.

I agree with rsn. In your situation it would be better to marry & get a C R 1. That would allow the use of a co sponsor.

Income and employment have -0- to do with petition approval. Fill out the forms truthfully. If you fill out the G-325a today your current employment is "unemployed". No problem.

You do not have to show any income/assets until the visa interview.

If you have not filed taxes, you will eventually need to explain why...or file them. Living in France DOES NOT excuse you from filing taxes, though it may excuse you from PAYING tax. Paying and filing are not the same thing. Again, it makes -0- difference for the petition, but will be necessary for the interview and AOS.

That statute of limitations on personal tax is for the last three years. 2009, 2008, 2007 (at this point) but 2010, 2009, 2008 by the time you will have an interview. You can get the necessary tax forms by Googling 1040/2009, etc. Fill ou the forms, send them in and make copies. If no tax is due, you will pay no tax and no penalties.

Secure employment or lists of assets before the interview. Thailand does not accept co-sponsors for K visas so you are on your own.

Chose the K1 because it gives us a project of the visa process

and a couple months in the states together before exchanging vows.

Filing three years of back tax forms is under way.

Sending packet I-129F next week, December.

Will arrange for employment starting in January.

Have others heard about Bangkok not accepting sponsors on the K1 visa?

Interview perhaps June?

Virtually everyone who has dealt with the Bangkok consualte says the same...co-sponsors not accepted for K visas. I do not know if it is writing anywhere...it would not have to be. Consulates can decide what they want on this matter. There have been several case reported here where people were denied visas when they tried to use co-sponsors in Bangkok.

Th interview will not occur until well into 2011 so I would focus on the 2010, 2009 and 2008 tax returns. You will actually need ONLY 2010 for the interview BUT for the AOS they ask for the gross income amounts of your past three years tax returns, so it is better if you have that answer and it verifies with what you have sent. It may actually be into 2012 at this point when you file for AOS so that would be the 2011, 2010 and 2009 tax returns. You can adjust accordingly.
