Dilema.. Hope some of you can point us in the correct direction.

Current Situation.. Im living in China (Foreign Spouse), and wife (US Spouse) is in US. We are just about to submit i130 while she is in US. Originally we planned for me to come to US once the process is completed, but today I found out that my work will keep me in China till Dec 2011.. So that being the case, and i will be in a more westernised city in China from January, i'm thinking to have my wife and daughters come and join me in China for 8 months.

Question is, do we hold off now for the submitting whilst in US and potentially not be able to travel there to visit, or apply for DCF in China say from July (when she would have been resident in China for 6 months ? She does have a residency visa and would have an entry stamp in her passport.

Anyone know of current DCF processing timelines in China ? from go to whaoo?

He's correct. Your US spouse would have to be a longterm resident of China for 6 months to apply. You are better off applying from the USA now or at a later date. Once you get the visa, you have 6 months to use it and it usually takes at least 6 months to get a visa when filed in the US. Your wife can still come live with you after it is filed while you are waiting but you will need someone checking your US postal address for responses from USCIS/NVC.

10-14-2010 : DCF I-130 at Manila Embassy

10-21-2010 : Additional requested supporting evidence received at embassy

11-05-2010 : I-130 application approved

11-11-2010 : Received Packet 3 via Fed Ex with MNL Case #

11-18-2010 : Packet 3 (DS-230 and Interview request) received at embassy

11-22-2010 : Calling to try and get an interview date set!

12-16-2010 : Medical completed in Manila at St. Lukes

12-17-2010 : Flying back to the US to prepare for Maricel's arrival

01-12-2011 : Interview Set

01-12-2011 : APPROVED !!!!!!!!!!!!!!!!!!!!

01-20-2011 : Receive Visa

01-25-2011 : CFO Seminar completed - ready to go!

02-12-2011 : Leave Manila

02-13-2011 : POE at Houston, TX
