Hello,

I am a UK citizen and am wanting to marry a US citizen. We are planning to start the application for the K1 fiance visa in Jan.

I am concerned because i had planned to go back over there in March and i'd heard that you can't enter the USA while the visa is pending.

It seems like an unclear area and i am finding it hard to get information on the topic.

Any help will be much appreciated.

You can travel to and enter the US while your k1 is pending. I would be careful about mentioning anything to the immigration officer about having a USC Fiancée' or getting married or anything like that. Do not lie, just do not volunteer information, when asked, your reason for visiting, you are here to visit your friend, tourism, etc. The Immigration officer can and will deny you entry into the USA of they believe your purpose is immigration. also UNDER NO circumstances Overstay your VISA!!!! this will most certainly jeopardize/delay your k1.

Hi Craig,

I have applied for K-1 visa in early September this year. I am Japanese and my partner is American.

Since my work requires a lot of travels to the U.S. I hired an American well-experienced immigration lawyer to get the right information.

Too much information is out there. We really have to be selective and smart about it. Also, you need to ask the right person.

I asked my lawyer if I could enter the U.S. for work before my visa is officially issued.

The answer is No. But technically you still could do it under the visa-waiver program for those who are from the allied countries including Japan.

But it is too risky. Very risky. My lawyer highly recommended that I should NOT give it a try even with the documents proving that i am invited to a conference as a speaker, i have a returning ticket to Japan, etc.

Craig, my advice is that it is better to apply for K-1 after your visit to the U.S. in March.

But if you still want to apply soon you might want to check if it is possible for your partner to submit a petition while you are visiting the U.S.

My fiance is from the UK and is coming to visit over Christmas, plus he was here in September, after we were engaged but before filing the K1. The UK is a low fraud country, so as long as you bring documents to show strong ties to the UK (lease, job contract, etc) you should be okay. Head over to the UK forum and search for visiting, there have been a TON of UKC come to visit their USC fiance(e)s during the process. It is totally legal to come VISIT so long as you don't plan on overstaying. It also helps if you come for short visits and DEFINITELY don't overstay!! That being said, there is still a chance you could be denied entry, but if you come prepared you should be okay. Personally, my fiance and I are willing to take that risk to see each other.

You'll file a petition, not start an application. No visa is pending until applied for. Usually applied for visas are issued within days and during those "days" the visa applicant's passport is in the hands of the Consulate, meaning they couldn't travel if they wanted to.

Filing a petition is not applying for a visa.

I need to clarify what i said in my first posting.

I am sure you understood what i had meant but just in case.

my partner filed a petition in early September. Of course, he did not apply for k1 visa though it is part of the whole process.

Currently I am at the waiting stage for NOA2.

Yes, after all it is up to you. I know some people who took the risk and visited the US.

But if i were you i would avoid any risky choices to make in this situation.

You are going to spend the rest of your life with your partner and continue to deal with the US immigration for quite a while.
