Dear VJ.....I need you help and advise on what i need to do a.s.a.p, My Green card expires by Jan 2011, I am no longer with my wife due to we dont get along and she has gone back to her ex, they have a baby now and are living together, now case is that she doesnt want to give me a divorce so that my papers can expire and i could go back to my country, i try to contact her by phone and email, but she wont respond to any of the two, i went to see a lawyer and the lawyer said i can file uncontested that will cost me $900, and i should go and try to get as much document i can get to proove that we got married in good faith, that is just doesnt work out, Unfortunately i i dont have enough document she has everything including the marriage certificate, but i was able to get these few doc.

1. Emails we exchange from time to time.

2. Our insurance card we had then that has my name and her name on it.

3. Membership card of a museum

4. 2 affidavit from people that knows we got married.

5. Photo of me her together, just 1 pic, and i have other pic of me and her kids.

I still have our joint bank card, but it has only my name on it, and she has called the bank to close the account.

Pls i need advice on what step i needed to take and how well i could go with all this i have, but i strongly believe that God is on my side and he will surely see me through.

Really you are looking at two separate things. You need to file for the divorce as soon as possible. I know from experience that every day that you remain legally married is another day that the spouse can screw you over financially. You need to get the papers filed (although $900 seems steep for an uncontested divorce). As far as proving you married in good faith, You have what you have. I wouldn't delay anything trying to convince her to give you the additional evidence.

Get the divorce, then go get your marriage certificate from the registrar, you can request one if you need it for your paperwork.

Can you get a couple more affidavits of people you two know stating that the marriage didnt work out but you tried to make it work and she left you for her ex? That might help with evidence for you.

i'm sorry you are going through this, in terms of your divorce perhaps if you share what state you live in someone with knowledge of the state can advise you of less expensive ways to file for divorce you may be able to do it on your own with just some court filing fees.

you will be able to get a copy of your marriage certificate just contact the county clerk in the county you married and request a copy.

your closed joint bank will still have your statements on file, you are entitled to access that, go into a branch with your identification and your account information and ask what you can do to get copies of the statements.

what about when you two lived together did you own or rent a home together?

did you have any utilities in your name?

did you receive any mail at the joint address?

I am sorry to hear you have to go through this, it is not an easy road. As far as the divorce goes, in your state, find out if there are free divorce clinics where they guide you through getting an uncontested divorce (pro-se) by yourself, they even supply you with all the paperwork that you need if you don't feel you can handle, you will have to hire an attorney.

The bank situation, call the bank and requests a letter with their company in the letterhead stating when the account account was opened, who was on the account and when the account was closed, that way even though, the account is closed, you still have proof along with your card that you did share an account together and statements, they will have access to it as far back when it was initially opened.

You can request a copy of your marriage licence at the clerk of the court office in the county you got married in. You also need to figure out what you are basing your divorce on, continous separation, adultery, abadonment etc.. The emails are good, when you guys lived together, where you on the lease, you can try and ask the people in the office for a copy if they still have a record of it.

Were you ever added as a spouse on any utility bills, was she an emergency contact on file where you worked, there a numerous things you can come up with. I hope this helps.

You can also send her a letter thru the mail, send it certified, return receipt requested. That way, even if she doesn't sign for the letter (probably won't), you have proof that you have tried to contact her. Also, keep a copy of the letter. Wishing the best for you. Good luck.

Time is not your friend here, and no matter how good a lawyer you retain, you can't beat the clock.

Here is how this game is played.

1) File for divorce. Get as many documents pertaining to your marriage as possible.

2) File the I-751 about 2 weeks before you Green Card expires. You will get the NOA1 and extension of your Green Card about 10 days later.

3) About 3 weeks to a month later you will receive an RFE for the missing divorce decree. They will give you close to 90 days to provide it.

4) It's March 2011 and you are still not divorced. USCIS automatically starts removal proceedings against you. You will have a day in court in front of an Immigration Judge. Your immigration attorney (there goes another $1K) will ask the judge to put deportation on HOLD until your divorce is final. The judge will okay that.

5) Once your divorce is final, hopefully before the NOA1 expires (in January 2012), your attorney sends the divorce decree to USCIS. They then can adjudicate your I-751. If you have good evidence, you'll get your 10-year Green Card; if you don't they deny your case and you are back in court detesting it.
