Help with affidavit of support

Hello, thanks in advance for your help.

Right now I have my mother (who is a US citizen living in the Philippines) listed as the petitioner. I am her daughter (I'm also a US citizen living in the USA) and listed as the 3rd party agent.

I'm filling out the Affidavit of support, and I was wondering if I can be used as the sponsor, since my mom (the petitioner) is not living in the USA right now.

Who is the visa for? Generally, the petitioner needs to live in the USA, or at least prove they intend to return with the beneficiary, unless they are outside on government business or similar...

You cannot be sponsor, as the petitioner is always the sponsor. But if your mother doesn't have enough income or assets, you can be co-sponsor.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

thanks for your responses.

anyway my mom (the petitioner) lived in the USA for years and became a US citizen. but about four years ago, she moved back to the philippines because she missed the rest of my family. Now, my sister (the applicant) wants to come to the US. I (the 3rd party agent) just paid for the processing fee and affidavit of support fee, and now I am filling out the affidavit of support for my mom (since she is old and doesn't have any computer savy).

i was looking at the affidavit of support form and it said that the sponsor had to be living in the US. is there a way I can be the sponsor (since i am living in the US and i have a stable job)?

You can sponsor your sister, but it will be a bit of a wait.

Ok. Your options are:

- You file a new petition for your sister, ie start over. You can be petitioner and sole sponsor. The wait for siblings from the Philipines is currently 19 years.

- You stay with the petition your mother filed. Your mother (the petitioner) would need to return to live in the USA before or with your sister (the beneficiary). Your mother must be primary sponsor, but you can be co-sponsor to help with the financial requirements. You cannot help with the residency requirements. Wait time is currently 13 years, or 15 if sister is married.
