Good Evening,

I'd like to know what are the steps I have left in order to obtain the green card for my stepdaughter. She is already in US and entered without inspection. She is 7 years old and I already received the DS-230 and I-864ez forms to fill out and send back (I-130 already approved). My wife (stepdaughter's mom) already got green card this past March through our marriage. My questions are:

-On DS-230 Part I, question #13 (Present Address), do I put down my stepdaughter's address here in US, which is our address?

-On DS-230 Part I, question #14 (spouse's name), she is only 7, so I am assuming this is a "N/A", right?

-On DS-230 Part I, question #19 (father's family name), is this my info as a stepfather or her real father's info?

-Does she need a waiver for the day of her interview in Dominican Republic as part of her consular processing?

-How do I go about leaving US with my stepdaughter for her interview? How much time prior to the day of the interview do we need to be in Dominican Republic? What is the process for my stepdaughter to leave US since she has no papers? It is like getting deported, am I right?

-Am I following the right path or was she able to adjust in US?

Any help would be greatly appreciated.

OK Where is your step daughter in the US or the Dominican Republic? Do you have your appointment yet?

Here are a few answer I have for you

On DS-230 Part I, question #13 (Present Address), do I put down my stepdaughter's address here in US, which is our address? No Put where she is currently living ( back to first question where is she now? -On DS-230

Part I, question #14 (spouse's name), she is only 7, so I am assuming this is a "N/A", right? Correct

-On DS-230 Part I, question #19 (father's family name), is this my info as a stepfather or her real father's info? No It is her Natural fathers name

Do you have a Notorized letter signed by the father ( if he is alive ) stating he is allowing his child to immigrate to the US? You will need to also send this with the DS-230.

As far as leaving the country with the child you will need to see what the requiremnts are in the Dominican Republic. In Colombia we had to have a doc Notorized by the Colombian Emabassy from the absent parent in order for the kids to leave , this was back in 2007.

Why is it that the only one who can stop the crying is the one who started it in the first place?

Thank u so much. She is in US already but entered w/out inspection. That's where I'm confused. How and when to leave once they send interview date. Do I need to pay for a waiver as penalty since she entered the US w/out inspection?

WOW I can not answer that one so sorry.. I would contact an immigration attorney if possible this is WAY out of my knowledge sorry :(

Stepdaughter already in US but entered w/out inspection. I'm confused about how and when to leave US once they send interview date.

Do I need to pay for a waiver as penalty since she entered the US w/out inspection even if she's a minor?

Hi, if the child is already in the U.S. why are you filing through consular process? You should have filed the I-130 and the I-485 to adjust the child's status here in the U.S. She can't go back to her country because she will not be allowed to enter the U.S. again since she is technically under deportation. I am not sure how you can go through Consular procedure. I think the best way to go is to go ahead and file the I-485 so you don't have to go back to the country of origin for consular process. I suggest you speak to an immigration lawyer but don't get those $$$$ suckers. Find if there is a Catholic Charities organization near you and contact them.

first let me tell you i recently did succesful consular process for my son. he was ewi and could not adjust status. any person regardless of age who enters the US without inspection will not be able to adjust status. unless they have a petiition filed for them prior to 2001. there are a few other exceptions wich i doubt you will qualify but still check. once you do the the application for her, it will be approved thats the first step, the second step will be for them to determine if she is eligible to adjust her status in the US. they will send you a letter telling you she must go for consular process in her home country. at this point u can get with a lawyer pay for consult and let them tell you if there is any possibility for her to adjust. if it is determined that she must consular process dont worry. any child under 18 is not penalized for illegal stay so that will not be an issue. just abtain her passport from her home country and buy her a one way ticket back home, you will have an interview in her home country. thier major concern will be who brought her to the states to begin with. DO NOT ADMIT TO ANY INVOLVMENT in bringing her to the us because that may lead to problems for any one who assisted i getting her there in the first place. they will grant her the visa as long as all your paper work is in order. she will be fine

This is great help. Thank you so much. We are now waiting for a response after submitting all required docs. No lawyer advice so far... Fingers crossed. One more question... We can just wait until a few days before the appointment at consulate to go with stepdaughter overseas for interview, right?
