wow now i am confused.....me and my fiance....well husband now.....went thru the same EXACT thing your SO experienced today only we got a 2 year ban and not a 1 year ban.....i am happy you only got 1 year but at the same time i am now furious we got a 2 year ban(which i might add was up as of YESTERDAY!!!!!!!!!!!!!!!! woohoo but since we married since then we had to refile.....ughhhhh......keep us posted chica and best of luck and positive vibes on a reinterview!

Hey all!

My husband had his interview this morning in Kingston.

I'll give you the quick run-down as to what he said happened...and am hoping someone out there can fill in the blanks for me.

He was sworn in, asked a series of questions, paid the fee increase, talked to about the army (selective service), and did a whole lot of waiting. At one point he was called up to a window and was asked the last time he smoked marijuana. During his medical exam, he admitted to last smoking 12/09 (which is the truth). He admitted this again to the CO at the Embassy.

The guy handed him a paper which is posted below. The only line that was checked was #4, which I highlighted. When researching, it says, "(iv) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to be a drug abuser or addict, is inadmissible." This was the ONLY sheet of paper he received.

The CO handed him the paper and his passport and told him that he needed to schedule another appointment for after December 1st and that he'd need to get a new medical before then.

Here are my questions:

1.) What's all this about "blue slips" I have read about when people aren't approved? Should he have received another sheet of blue paper...or is the information below usually on blue paper (it was on white)? If this is not the usual blue slip, what does it usually say?

2.) I also read that when people are denied because of admitting to previous drug use, it usually occurs along with a 3-year ban. Why does he only have to wait a month (not that I'm complaining!)

3.) Do you think that it is possible that he did not have any drugs in his system, but since he admitted to having used in the past, they want to re-test him to make sure he doesn't have any in his system any more? This is my only possible answer. I'm SOOOO confused!

Any advice/ideas would be VERY helpful! Thanks! :)

Based upon the information your provided, your husband can re-apply, meaning reactivate his application. Did he fail the drug test? If he failed the drug test, they will not allow him to immigrate for 3 years.

I think it is way past the time to bump up the thread about how to answer that dreaded question "If you have ever smoked Ganja before".... Anyone from the yardie group know where it is??? I am beating it into my hubby's head....NEVER NEVER NEVER admit to EVER EVER EVER smoking weed. The Jamaican embassy doesn't play!!!! We need to advise any new people going through the process that being honest unfortunately in this situation doesn't win.

Oh and another thing....at my husbands physical..they didn't even ask him anything about if or when was the last time he smoked....hmmmmm

I TOTALLY AGREE!!! This is one time where honesty is NOT the best policy! Such a shame. To me it's like they are looking for any excuse to delay or pre-empt the process!

THANK YOU ALL for your support! Times like this can be challenging! I cried for a while yesterday morning, but then I talked to my mother-in-law and she said, "It's only one more month! Think how fast the past 2 months went by as you waited for the first interview! You two love each other and will be together soon!" :) I had to agree and felt much better after our conversation! I sent an e-mail to the embassy yesterday, as well...and will let you all know as soon as they reply.

Did you ever get a response?

Sorry to hear about your letter! But you still have hope, I'm sure he will get a visa! My hubby and I will be going through this later on, will all the things I read about possesion of controlled substance we are very very nervous. :(

In 1998 12yrs ago he was caught smoking a joint with his friends went to court and got a conditional discharge, the judge told him to be good for 1yr and he will drop the charges and he did. I belive he had between 1-2grams. And that was his first and last time smoking. Soo in our case we can't tell them he's never smoked because it's on record. I'm soo scared. Hopefully everything will be okay. I will continue to pray for all of us =)

Hey all! Okay, so I've been away from a while...but here's the latest...

I e-mailed the embassy after he was "blue slipped," (although he never got a blue slip) and they FINALLY (weeks later) told me I needed to wait until December 1st to e-mail them back to request a second interview.

December 1st I re-submitted our request and he was scheduled a February 11th interview. He needs to get a new medical exam before then (to prove that he still doesn't have any weed in his system).

I'm bummed he won't be here for the holidays, but I'm heading down Christmas and staying through New Years...and CAN'T wait!

CJB--I just realized that you posted here. I have been following your case since your interview and was waiting to see your follow up. I am glad that you have a new interview scheduled and look....I am so darn late that now your interview is only a month away. The time will go by so quickly, just as quickly as the holidays came and are now gone. My husband's 2nd interview is 1/21 and we can't wait. I am just hoping that he will be approved and we can begin the next phase of our lives. Good luck but hey, you won't luck. Every likkle ting a go IRIE.. Take Care...

Minted..all will be well. It has been quite a few years since use and CJB115 posted new guidelines that state that the applicant is ineligible if one year has not passed since last use. Hopefully this is being interpreted correctly and you and hubby will be just fine. Our interview is next week so I will be able to provide you with more insight afterwards since my husband has a similar situation. Take care. Are you still waiting on your interview date?

i know it isnt quite the same, but a member here had a dui conviction 2 or 3 years ago and was recently denied. Under the 'health' sub heading. An option to file a waiver was given however.

The member was told to return after completing their first interview, to return for a second interview a couple of weeks later. Upon which they were ultimately denied.

As I said Im not sure if it applies in your cases - hopefully not, however just in case, I had an i601 waiver ready for my denial (overstay) and was able to file it on the day of my interview.

Hopefully this is being interpreted correctly and you and hubby will be just fine. So far in our case we are at the NVC stage. I submitted my AOS and it has been accepted with no RFE's, entered into the system. My hubby just sent in his IV stuff a week ago. So we are closer to a interview soon... i hope.

We do have some updates about his prior arrests though. The marijiuna we got a synopsis from the police station and it seems he had not even 1 gram of marijuna on him it was something like 0.0657 or something. And when the police officer caught him he just put him in the back of the cop car then took his stuff away, and let him go... i guess he just put it in the police system. Thenn the police records also say that the judge had the charges withdrawn. Soo he has no conviction for marijuina. and the other purse senario he was on a conditional discharge for a year and the charges were dropped. So God willing everything will be okay!

Everything will be just fine. My hubby had his interview yesterday and it was disappointing but not denied. He has to have a second medical and return for another interview at which time he was told he will just drop off the medical and his passport. This process has been long but I strongly believe that everything is for a reason. So, he just needs to have the medical after Feb 1 and then we request the interview. I sure hope that the interview date will be close. Take care..
