I know that I am allowed to file the I130 for my step-daughter. She is under 21 and not married. Will they consider this an immediate relative and allow her to be processed any faster?

Did you marriage take place before she (your step-daughter) was 18 years old? If so, she will be considered your child, regardless if she's biological or not. She is your immediate relative. A USC petitioner is faster than a LPR petitioner most of the time. So, I would have you, the USC, petition her.

Good luck with your journey!

Yes, she is 16 years old...what do I need to do then?...I really need to get her here as quickly as I can because it is hard on my wife and on my step-daughter too...there is no biological father in the picture...If there is anything that you could inform me about then I would greatly appreciate it.

You should fill in your information and your timeline, that will help others understand where you're coming from and where you stand. For instance, did you do any immigration process for your wife? I ask because the process for your stepdaughter might be different depending on how you got married. If you filed a fiancee petition for your wife (I-129) then your stepdaughter might qualify for follow to join status.

If you are starting from the beginning with your stepdaughter and not based on your wife's immigration process, you need to start with filing the I-130 petition. You can get information on the process here. Good luck!

Just starting the journey, haven't yet filed... Until today(2/12/07)!

I'm kind of new to the website and hadn't been getting on here much but I am planning on getting on here more now so we will work on filling out our time line. My wife came over here on a tourist visa. We got married Aug 3rd and she is living with me in Indiana. I am going to file the I130 I485 and I765 for my wife and the I130 for my step-daughter this week, I had to come up with the money before I could do anything. We are really wanting our daughter over here with us as soon as we possibly can. She has no biological father in the picture he never has been in her life and she is living with her aunt and uncle in Honduras and things are getting a little stressful on my wife and my step-daughter. They really miss each other and my wife is so close to her daughter.

Expect the process to take the better part of a year, 7 - 12 months. I'm not familiar with the wait times for interviews in Honduras so it could be a little more or a little less.

Apply for AP for your wife so she can travel back to visit her daughter in a few months without having to wait for her Greencard.
