Co-sponsor's last name is different on their birth certificate and taxes

Hey guys!

I asked this question before, but didn't really get an answer. So, I figured I would ask again before we send everything out.

Our co-sponsor was married (now divorced), so the last name on her tax papers (her married name) is not the one that is on her birth certificate (her maiden's name). Will that be an issue? I raised the question with her and she said that since they have her SSN, they will be able to see it's her... but that didn't make a lot of sense to me.

Can anyone give me some input regarding this, please? :)

Adjustment of Status

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done

In my own opinion, you can send a copy of her divorce decree or proof that she was then married and changed her name after divorce. Then explain why you included it. Doesn't hurt.

4/29/2016 (Day 10) - Biometrics Scheduled

5/10/2016 (Day 20) - Early Biometrics (Walk in) Originally scheduled for 5/18 @ 2pm

8/16/2016 (Day 120) - Scheduled for an interview

In my own opinion, you can send a copy of her divorce decree or proof that she was then married and changed her name after divorce. Then explain why you included it. Doesn't hurt.

That is what I was thinking. Honestly, at this point, what's a few more papers... My package is already 3/4" thick. :(

She might be able to get a copy of her marriage certificate at the courthouse. They keep those on records, I'm sure.

I hear ya ;) It's better to be sure and not get RFE's. But then we would never know what they need. Good luck on your filing!

Double check everything! Most importantly signatures...

HI Kitty,

I see on the main page for the I-864 that you MUST include proof of current employment, as I suggested before. Here: http://www.uscis.gov/i-864

Regarding co-sponsor name change: I think (opinion only) that a name change can be explained in a cover letter. Also, there is enough room on the "864 name line" to write something like "Jane Doe (formerly Smith)." I suppose that copies of her marriage and divorce decrees wouldn't hurt, but I don't think anyone one here will know if they are required. Good luck.
