Hi,

I have a very important question and hope some one with knowledge and experience can help me with it. I previously posted a topic ( Naturalization) in which i stated how my I 751 ROC was denied due to USCIS error , then receive NTA before immigration Judge in removal proceedings and on the day of hearing the judge find it out that i have been issued a wrong Resident card as I enter to US after 2 yeras of my marriage and that there is a mistake in issuing a conditional Resident Card. The judge terminate the case. I then file I90 to replace my already expired 2 years card and finally received my ten years permanent Card in jan 2010 having Residence since 2-1-2006 date and expiration date jan 2020. Now since i'm eligible to apply for naturalization next month i want to clarify some concerns i have.

1- What will be the exact date to apply.

2- Does any of these applied to me About Part 10 of I 400 application

25- Are removal, exclusion, recission or deportation proceedings pending against you. YES or NO

27- Have you ever been ordered to be removed, excluded or deported from the United states. YES or NO

28- Have you ever applied for relief from removal, deportation. YES or NO

You can become a USC not earlier than 3 years before you became a LPR. You will find that date in front of your GC. You may file anytime starting 90 days before the 3rd anniversary of you residence.

Yes, better safe than sorry. List the incident and I suggest dedicating 1 paragraph of your cover letter explaining USCIS's previous mistake.

The USCIS already has a record of this incident in your file. So when they review your case for citizenship, they will come across it.

Your best bet is to find a good lawyer and get a letter from him/her explaining the USCIS error and include this in your package for citizenship.

I dont think your citizenship would be denied because of a prior error on the part of USCIS

Just looking at my wife's green card, well a copy of it, they took it away from her when she got her certificate. There is over a 13 year span of time from the date she became a resident and the expiration date of that now defunct card.

This huge span in time had nothing to do with errors, but is typical in normal processing times. Ours would have been much longer if it wasn't for calls to our senator's office, they misplaced her application and we would have been driving back and forth getting I-751 stamps in her foreign passport. This has happened to many on this board where that span of time is over 15 years until the USCIS finally looked into it.

Just saying there is nothing abnormal about the dates on your green card, and you are worried about nothing. Typical SOP with the USCIS, standard operating procedure.
