I am the petitioner for my husband who came over on a K-1 Fiance Visa. I do not make enough to send in the I-864 on it's own, so I need my father to help. Do I still have to fill out the I-864 even though it will be based on my father? I am guessing since I am the petitioner, then I am also the sponser, which makes my father need to fill out the I-864A...Am I right?

Any help would be great. Next step after this is denial, because we already received an RFE over a stupid mistake on my part.

Thank you VJers

YES.... you as the petitioner must fill out the I-864

Your dad can fill out the I-864A if he is in your household otherwise the Co-Sponsor form...

Be sure to have him submit all the necessary documents that show the relationship to your and residency... you can send both documents in the same packet to save on shipping cost and processing times.

Be certain to check for errors before you send them off.

Yes, you fill out I864 even if you make zero.

If you and father live in the same house together, then he does I864A giving his permission for you to add his income to your I-864 in the place where it asks for income from household members.

If you and father do not live under the same roof, he does the I-864 form as your joint sponsor.
