Hi. Just double checking on completing Form I-751 .... I assume Part 5 is only required for any immigrant children or do we still need to list all children?

Ok, so we should list my wife's biological son (my stepson) who lives with us and as well as my adult children who live in Canada?

We listed only my children (I'm the GC holder), who are all adults living living in Canada. We didn't list my US citizen step-children, although they don't live with us. (None of the previous forms in this loooong process have ever asked for information about my husband's children, so I wouldn't think they would suddenly want that information now.) Not sure if this is helpful or not. Perhaps you will get a response from someone with the same situation.

My concern is that USCIS will get confused and think that they are included in the petition. You know how easily they can get confused eh ;)

That's for sure!

I've been going back and forth on this but since I listed them on my original I-130 (and then noted they were not accompanying me) I am doing the same for ROC. On the I-751 I have listed their names, DOB, A-number as "None" then checked off "NO" for "Living with you?" Fingers crossed they'll figure it out.

Let us know what you decide to do since you're ahead of me . :lol:

Is this the correct approach? Any other opinions? I am just one and half months away from filing (I hope to file on 11/16/2010). By the way, in my case, I do have my wife's son who is 21, but since he came later, we cannot file for his removal of conditions until March 2011. So I will be pending on what's been said here. Thanks.

My own reading of it is that you list all of your children. Then, you include a biometric fee for any of those children who are conditional residents for whom you are applying for removal of conditions at this time.
