My wife and step-daughter got their conditional green cards on the same date in 2008. At the time of receipt of the green card my step-daughter was 19 years old. My step-daughter is now 21 years old and we are now within the 90 day period for filing to remove the conditions on residence. My step-daughter is a full-time college student and I will be able to claim her as a dependent for tax purposes for 2010. Can I include my step-daughter in my wife's petition or does she have to file a separate petition?

NO, each one has to have a single petition filed. Since daughter is over 14 years old, you pay 2x $545.

You can send both petitions together in one envelope.

I appreciate your reply but I am not sure about the reason you give that would require my step-daughter to file a separate petition. Using your logic my step-daughter would not have been able to get her K-2 visa since she was over 14 at the time that I applied for my wife's K-1 visa.

I know that my step-daughter does not currently meet the definition of a child in Section 101(b)(1) of the Immigration and Nationality Act but she did meet that definition when she was issued her conditional green card.

Again I appreciate your reply.

I called the USCIS Customer Service Center and asked my question. They told me that I could include my stepdaughter in the petition since she was 18 years old when she entered the country on her K-2 visa and was considered a child at that time. I will file the petition for my wife and step-daughter later this month and I will report back later on whether or not it was accepted.

I must trust my fellow civil servant. I also work for the federal government just for a different agency.

I seem to recall that the IRS gets about 50% of its answers to called in questions wrong.

I do believe your step-daughter will need a separate petition. Certainly will be paying 2x $545.

I have worked for the IRS for 36 years. The IRS and USCIS are like any other organization, you have good employees and not so good employees. The lady that I spoke with at USCIS did not answer the question right away. She put me on hold while she did some research and then came back with her answer. To me that is a sign of someone who is trying to give a correct answer.

I will be sure to let you know whether or not I get my wife and stepdaughter's conditions removed with just one I-751.

The answer to my question is yes. My wife and daughter both received their 10-year green cards today.
