Out of curiosity and to better understand visas in general I wanted to know what would be the profile for the following:

  • Male Aged 30
  • Single
  • Residing in a Developing Nation like India
  • Has Family in America and simply wants to visit them by applying for a Visitor Visa

Based solely on this skeleton profile, what would the US Embassy conclude without knowing any further information ?

What assumptions would they make about this profile ?

Additionally, what circumstances and ideas would the visa applicant have to try and overcome in order to be awarded the visa ?

CR-1 Visa Was Approved :-)

Entry Date to USA: 2/3/2011

12-10-2012 - Sent off I-751 packet visa USPS

I751 Was approved - 10 Year GC was granted

N-400 Progress

Assumption - He is not going back to India after his visa expires. Because his family is here, no real reason to go back. Young single males trying to escape unemployment or other horrible conditions of devolping countries. Sorry for being staright forward.

Assumption - He is not going back to India after his visa expires.

Section 214(b) of the INA requires USCIS to make that assumption for anyone entering on a non-immigrant visa. The applicant then must have proof to overcome this.

I would tend to agree though, for a 30 year old single man there would have to be an overwhelming amount of supporting evidence to convince USCIS you would return home. Evidence such as property, relatives, investments etc.

in short, you would have to demonstrate that your life in india is good enuf that you would not ditch it upon entering USA. about 20% of ilegals in the USA are failure to depart on expiration of tourist, student, or work visa. offending countries that top the list for such failure to depart are india, china, and philipines. offending profile are teenage to 35, male or female, single and childless, with family in USA.

you need to demonstrate a high paying job, an owned house or apartment, a wife and child to leave behind during your visit, or lots of business property. cash in the bank is not good evidence, as it can easily be shifted from one account to another. close family in USA is a definite negative come interview time.
