Do you think I need a joint sponsor?

I do not have tax returns for the last 3 years since I was a student and then making less than $9,000/yr teaching abroad. from June 2009-June 2010 I was unemployed. I just got a full time job 2 months ago. My annual salary is $41,600. My household is 3, so I am above the 125% min.

Do I need a joint sponsor?

The problem is that my mother who was going to be my joint sponsor was just laid off this month. For the past 3 yrs she had an annual income of $110,000 or more. I have her 3 tax transcripts from the last 3 yrs. She does have a severance agreement until April 2011 of 100% of her income (120k).

If I need a joint sponsor, can I use her?

If your current income is enough (and you can prove it) to meet the poverty level needed, you do not need a co-sponsor.

You will probably want to ensure you get a letter from your employer stating that your job is permanent, with salary info, (when you started, etc...)

About using your mother - You may be able to, however, if they ask for proof of current employment, she will not be able to show that.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

In addition to a company letter, you may also want to use your payroll stubs... as for your mother, even if not employed, she can declare any assets in a checking or savings account to become a co-sponsor (1/3 of the amount in the account will count towards reaching the 125% threshold)

Nope. The 3:1 ratio only applies to someone sponsoring a spouse or child, so it would apply to the primary sponsor. If the co-sponsor is neither the spouse nor parent (not step-parent) of the sponsored immigrant then the ratio is 5:1.
