i am filling out my mom's N-400 and there is a question in part 10, Have you ever claimed to be a U.S Citizen ( in writing or any other way)? she filed once and she failed the exam so she has to send in a new N-400, so would she answer Yes to that question right ??? because it says on top to provide explanation and additional information to explain it.

Why would filling out a citizen application be claiming that she was a citizen?

this is a language misunderstanding i believe.

your mom is not a USC (U.S. Citizen). so has she ever told anyone (falsely) that she IS a USC? has she ever falsely filled out paperwork stating/claiming she is a USC?

hope this helps

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

Claiming to being a US citizen relates to registering to vote or getting a drivers' license as just two examples. Am under the impression if one fail either the English or Civics test, the USCIS does give a second chance with the same application. Did your mom get this chance?

hold up there... IDK about all states but getting a DL in some states IS allowed.

I sure hope so or else the folks at the New Jersey Motor Vehicle Commission are in big trouble.

 Of course it is! I just had to "provide proof by the U.S. Immigration and Naturalization Service, authorizing my presence in the country" not that I was a citizen.

Granted all states are different, was just thinking about Wisconsin, don't need a green card if you just check I am a US citizen box. Same with voters registration as no proof of US citizenship is required. Many came here that were granted voters registration by the simple act of applying for a drivers' license.

Its not so easy with SS, they want to see an EAD, green card, or a birth certificate. The latter is easy for some, visit a cemetery and find somebody the same sex, ethnic, and age, get on the internet, learn their ancestry, name of parents, etc. and apply for one of theirs over the internet. But first get a drivers' license as the DMV is easier to fool so you also have a photo ID.

Yes, we have holes in our system, congress and state governments are aware about it, but just talk about it, and don't do anything about it. Mostly because they need those extra voters.

But again, examples of claiming to be a US citizen when you are not. But by answering no to the posters question gives the USCIS reason to deport you if you are caught. Just like saying no to did you ever commit a crime you weren't arrested for. If you did and were caught, you lied on your application, so expect to be deported.

Just applying for US citizenship twice, sure not why, unless she flunked her second chance is not claiming to be a US citizen.

If the mother has never FALSELY CLAIMED to be a USC (verbally or in writing) the proper answer is "NO" on that Part 10.

language misunderstanding :D . thx guys :)

Government forms do that to me too, some psychological subliminal trick they must use to twist your brain.

Another thing I have noticed, always have problems with printer jams when printing out these forms and never have problems printing out anything else. Can't seem to find any software or hardware problems, can print out other .pfd files normally, but must be emotionally disturbed with USCIS forms.

Found it very effective to soak my head in a bucket of ice water for an hour after reading and typing these forms, that way I can go on with my normal life.
