Today we received my spouses EAD but now need to get her SSN. My question is she is here on VWP and is past the 90 days and we did not get a SSN while the I-94 was valid (within the 90 days) can we still get her a SSN or will we have to wait for her green card to get one?

Hi If you received the EAD card you can take that to the social security office along with her passport and birth certificate and get her a card now, you don't need to wait for the green card

Here is the social security card link that should tell you all you need to bring with you to apply and also the application you can fill in and print off to take with you:

You don't need birth certificate, just the passport and EAD will do.

Her work authorized status must be verified before the SSN can be assigned. The bad thing that sometimes happens when a person applies with an EAD card and the AOS is pending, the status verifies as application pending instead of full time work authorized and the SSN application cannot be processed. Not saying it will happen in your cases, but keep in mind that it could happen.

If you have the birth certificate handy take it. If not just take the EAD card and passport.

The main thing is when the SSA office tries the verification while you are in the office and it doesn't verify, as why, since the name is allowed to be one letter off and still count as verifying. If it is any other reason, the secondary electronic verification will need to be submitted and that normally comes back with a response in a week, don't let them tell you four weeks. The response to the secondary electronic verification request is where the application pending vs full-time employment authorized problem comes into play. If the response is that immigration needs to see a copy of the document, then the copy is mailed along with form G-845. The time for the G-845 to be processed and mailed back to the SSA office can take a month or more, but the SSA office has a number to call to ask what is going on if the G-845 hasn't come back within a month.

So do you think it would be a good idea to go back after a week (when they send the secondary electronic verification) and prompt them to send off the documentation?

And yes, it's a good idea to take the birth certificate. On my (two) failed attempts at getting a SNN when my I-94 was valid I didn't have my birth certificate with me and they tried to tell me that they couldn't process my application without it. Even though I had a valid passport and I-94...

If you know it has been submitted and you have the time, I would go back to the office after a week to ask if a response has been received. If it has comes back, hopefully it has verified the immigration status and the application can be processed. If it doesn't verify, ask why. If immigration wants to see a copy of the document, say to them "So you are now going to send a Form G-845?" That will let them know that you know the next step and if they say yes, you can start the clock on the month for it to be mailed and mailed back to the SSA office. You can check back sooner than a month to see if the G-845 has come back, but figure on a month.
