Hi,

Met my fiancee' a year ago online, she is in the Philippines and I'm in the US. Last month I travelled to meet her and we have decided to get married, YAY !

OK, my question - do I need a certified copy of my divorce decree ? Instructions aren't so clear, did some searching, but so much info here........

Thing is, I asked my divorce case to be sealed as the ex was making a bunch of BS claims (none of which held up and I enjoy partial custody of the kids)...in order to get a certified copy, I need the case unsealed..

Any help ?

Thanks,

Rich

I'm not sure bout the sealed case issue but you definitely will need a certified copy of your divorce decree somewhere along the way.

Good luck!

Certified copy is required with the initial petition filing. Do what you need to get one. No other way out.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

Initial petition ? Any chance I can send in copies while waiting on the real deal...from what I've been reading about proof of meeting, that should be copies only ??

Thanks,

Lots of good info here....

I just sent a copy of my divorce decree with my I-129F petition. It was never questioned. I went through the trouble of getting a "true and certified copy" from the county registrars office and sent it along with other paperwork to my fiance for the interview. They never asked her for it.

I guess I would say you could try but sometimes they ask for different things. The only thing it will cost you is time if they want the true and certified copy.

Good luck!

Thanks Jean-Bill.

Wow, I just clicked your timeline, that's awesome -

Your I-129f was approved in 52 days from your NOA1 date.

Your interview took 92 days from your I-129F NOA1 date. She's still not here yet though ?

Man this is confusing...lol.

There's lots of good info in the guides section and that little search bar helps alot too. Can't say we would have been so fortunate if it weren't for following the advice given here. We prepared a lot for the interview. She printed copies of emails, chat logs, receipts for things i sent, etc. All she was asked for was 2 pics of us together. Better to have it and not need it I kept telling her. She was kind of pissed that she carried all of that for nothing. hahaha

I'm leaving 8/28 to go back over for 2 weeks and she will be coming with me on 9/10. Won't be long now! :)

Good luck with the paperwork. You'll be an expert in no time at all.

2 Australians were put into administrative review after their visa interview this month for not having a fully certified copy of the divorce decree available at the interview when it was asked for. They both submitted photocopies of the decree only with their original petition. It does pay to have it just in case its asked for. Their visas have been approved but werent affixed to their passports until such time as the full certified copy of the divorce decree was provided - a delay of a couple of weeks.

Another hiccup - please help.

I-129F, Question 11.

Have you ever filed for this or any other alien Fiancee' or husband/wife before ?

My ex immigrated from Korea, we married there and submitted the K3 (I guess, long time ago)........

Is the answer to question #11 yes then ?
