Hello everyone,

I recently posted updating everyone on my husband's denial of his CR1 Visa. Actually I'm not sure if it was denied because they CO that interviewed him actually told him that she wasn't denying it that she simply had to return the case back to USCIS for further review. Briefly, the other items were: that he answered the questions about my birthdate in the Egyptian format vs. the American format and because the CO states he did not know how long I lived at my current residence, which my husband swears he was never asked that question. Anyway, can anyone here please maybe give me an insight on how long I have to wait for USCIS to give me their final decision? Our case will be at USCIS for a total of 4months on the 13th but one of their reps has told me an answer can be made as early as 120days (the 13th of August). But when I look on the website it only states that an I-130 is currently taking 5months????

Any suggestions? Ideas? Has anyone gone down this path with USCIS, California Service Center and give me a more accurate idea? I am really trying to be patient but I am going crazy without any news or update from USCIS. Everyday I check their website and nothing's changed. I've also signed up with them to alert me via txt/sms message as soon as they reach a decision.

05/08/2012 - DS-230 IV Fee $230*2 paid

05/09/2012 - DS-230 IV package mailed to NVC

05/17/2012 - Case Completed

07/02/2012 - VFS visit in Cochin

Some questions to ask, of any USCIS Tele-Rep -

1. where's my casefile, currently?

2. when was it received from the US Embassy?

3. exactly which office has it, now?

4. please verify my postal address.

5. Has the review process started yet?

6. Will I be required to submit further evidence, or is the casefile complete to your satisfaction?

The pity of this, really, is that the first-line Tele-Rep won't know any of this - and you'll need to wait whilst they flip pages in their script book, trying to find the right answer to read to you.

Be patient with them, let them expire their breath, when they FINALLY WIND DOWN, and pause -

then YOU ask for a 'Visa Specialist' or 'Immigration Specialist'

then start the question list again.

The DOS Hotline will also know a few things, about exactly when the casefile was sent back, and when it was received in the USA.. If the casefile is still at the US Embassy, they should be able to tell you that (when asked) as well. That majic phrase 'Is the casefile under administrative processing at The US Embassy in Egypt' will give you some definitive answer, as well.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Sorry to be responding so late...I have been sick for a few weeks now with Pneumonia.

To answer some of the questions you asked:

The case file left the Embassy a few weeks after my husbands interview. I believe that was in part because my Congresswoman got involved, contacted them regarding the possibility of the case remaining at the Embassy & issuing a 2nd interview instead...What did the Embassy do? They sent our case out so fast & replied to my Congresswoman that it was too late to ask for our case to remain in Egypt. LOL. How convenient.

I got a NOA from USCIS, stating that they had received our case on April 13, 2010 & that they are currently taking 180days for reviews. For me not to contact them for case updates before then. =)

So, the 180days will expried on September 13, 2010. I logged in to my USCIS account and saw that they have last touched my case on August 31, 2010. My concern now is, will they keep the 180days or can they take longer than that? My Congresswoman is waiting until the 13th & if I don't have an answer from USCIS, she will be contacting them for a status update.

I hope my husband & I get re-affirmed & that the case does not go back to NVC, where it will get delayed...Or will it do straight to the Embassy if USCIS re-affirms?

Suggest you revisit what I've written here, plan yer strategy and attack, via telephone, using the lists I made for you, earlier.

IMO, phone contact with the right person, at this stage, is really important. Don't be a shotgun when a rifle is needed, yes?

IMO, phone contact with the right person, at this stage, is really important. Don't be a shotgun when a rifle is needed, yes?
