NOA1 wait times?

Hi guys,

So... we originally submitted our I-130 in June, it was sent back. We thought we corrected it, resent it in, again, it was sent back. My husband sent it in AGAIN on July 15th and we have heard nothing. The two times it was sent back, we had it back within 7-10 days. Now we have been waiting for 20 days. His delivery receipt says it was received at the destination on July 21st, 2010. So even if we go with that date and not the date he mailed it, we are still at 2 weeks. Additionally, the cheque he enclosed, has not been cashed yet. At first we thought it was taking longer because maybe we got it right this time, but now we are starting to worry. We don't even have a case number to call and inquire about. How much longer should we wait? and if we don't hear anything, should we put a stop payment on the cheque and re-submit for a 4th time?

The general rule, as I have been told on VJ is that you have to wait 1 month longer than the National average time of approval. Meaning, if you filed in July, and there was a 6 months average wait time, you would have to wait until February to call and inquire into the situation.

You know they received it, so I would just sit back and start the long wait with the rest of us. Don't waste time and money canceling checks when that alone could delay the process even more!

NOA 1: Received 2-16-10

NOA 2: Approved 4-29-10 (72 Days)

NVC Forwarded Petition to London- 5-6-10

London Mailed Packet to Rob: 5-18-10

yeah I just didn't think the NOA1 would take this long. I knew the NOA2 was going to be a couple months, but from what I had read it was looking like NOA1 was going to be 7-10 days from receiving it. We are just getting anxious because if this doesn't work, he has to drive 3.5 hours to Memphis to see someone in person to help with our rejected application. :(

Memphis is about 2 hours from me as well, so it's not really that big of a deal. The whole process for us was "supposed" to be finished in July, but notice, we're not finished either! The most you can expect is to not expect a timeline. They work in the their own little world at their own little pace.
