I have know someone who asked me if i can find out for them if her ex-husband can file a petition for her as a fiance. They are in their late 50s got divorced when the husband jumped off the ship and married a US citizen. Now the husband is divorced from the US citizen wife and went home to their birth country for about 6 months. Can he file a fiance visa petition for his ex-wife (original wife)?

Sounds fishy to me... I doubt it would be an easy thing to pass.

See profile for our K-1 Visa/AOS story from 2010-2011Apparently we love USCIS/NVC so much we left and are doing it again! This time giving IR-1 a whirl. Rock on immigrators.

07/09/2014 sent in IR-1 packet to Chicago Lockbox

07/16/2014 NOA1

07/17/2014 check cashed by USCIS

10/01/2014 found out we are expecting baby #2 June 2015!

12/15/2014 NOA2

12/30/2014 Case received by NVC

03/23/2015 Received Case and Inv # from NVC after many calls and bogus excuses.

03/24/2015 AOS payment accepted by NVC

04/09/2015 IV payment finally accepted by NVC after the set the wrong fee and took weeks to correct it.

*many more delays thanks to the agency processing my fingers prints to the RCMP and the post office losing our mail*

05/20/2015 Packet sent to NVC via UPS, eta May 28.

06/16/2015 Baby #2 due - homebirth in Scottsdale, AZ

perfect scenario for 'visa fraud', IMO -

where the foreign spouse comes to USA, gets status, then divorces after getting US Citizenship -

then 'finds the previous woman' in the 'home country'

and files the petition for her.

Is it possible to file a petition? sure !!

Will it get denied at the US Consulate/Embassy on interview day? Hard to say, depends on which country it is.

if this 'husband' is not a US Citizen, please note - only a US Citizen can file an I-129F petition.

Another issue that I smell - no record of 'divorce' from the 1st wife - so the USC will scrutinized at USCIS with the namechecks, and most likely 'denied' at USCIS due to alleged bigamy.

they could try although they may have to undergo a lot of questions before it is all said and done there case seems as if it might be some red flags along the way. What country is the ex-wife trying to immigrate from?
