AOS - Should Petitioner File under Married Name

We finally got through the K-1 Visa process and my fiancé is due in the States in a couple of days! We will be married at the end of this month! So, when we file for AOS, I will also be in the process of changing my name to my new married name.

As the US citizen (petitioner), should I complete the AOS with my new married name even if I am still in the process of changing it?

All of the K-1 paperwork with my maiden name, obviously. Also, a bunch of my legal documents (drivers license, passport) will still be under my maiden name.

Thank you!

Thanks, but I am the US citizen, not the one who will have the green card.

As the US citizen, I petitioned for the K-1 visa with my maiden name. I am wondering if changing it for this part of the process is confusing or expected. Or how do I indicate that it's my married name?

thanks!

You are not the first nor will you be the last one... use the name you wish to be as your legal name

YMMV

I had the same question and consulted with a close friend who specializes in immigration law matters. She told me to go ahead and use my new (married) name to file the paperwork. I did with no problems at all. Following the filing of paperwork, I started the name change process for ssn, dl, and passport. I actually had all of my new documents in hand a few days before the interview. I don't think there is any expectation on the part of USCIS as some people get married and continue with their maiden name, but for me,I felt more secure showing that I had taken his name as it felt like more of a proof of bonafide marriage. Good luck to you!
