Hello VJ and all,

I just checked my case status online and learnt that my I-134 has been approved without an interview. It says its at post decision level and the application has been approved and sent to National Center. My fiance (US citizen) filed for me in Feb 2010. It was a long wait!

I am confused about the following, and would appreciate if you could help me with these questions, Thanks in advance.

1. How long does it take for me to receive the K-1 visa and when can I fly into the US from the date it says as I-134 approved (online case status)?

2. I am a UK citizen but of Indian origin. I am currently visiting India and plan to be here for another 2 months. Do I have to go in person to the US consulate at UK to receive my K-1 and then fly to US from there? Or I can visit US consulate at New Delhi, India and fly to US from India after receiving the K-1 Visa from New Delhi?

3. What all do I need to show at the consulate?

4. The USCIS website says they will contact me when I can go to the US consulate of the foreign country. How do they contact me? I mean by what means do they communicate? By postal letter, phone number?

Thanks, would appreciate if you can provide me information on these concerns.

Hi,

I am a bit confused here; are you saying your fiance also filed the I-134 form with the I-129F? Are you sure this is true? In any case, he will need to send you another I-134 form and you'll have to take it with you at the interview. You said your case was approved (it was the I-129F that was approved!) with no interview...There is NO interview at this stage; the only interview you will have is at the US consulate. Now, regarding your questions:

1) Your file is sent to NVC, where they do a check-up on your fiance (the petitioner); that usually takes about 1 week (more or less). Afterwards, NVC will send your file to the US Consulate and that's when you will receive packet 3 with the forms you need to fill out and some more instructions. You send back what they ask you to and you either wait for packet 4 or you call the Consulate to set a date for your interview (and this also answers your question 4)...

2) on the I-129 F that your fiance filled out there was a question regarding the Consulate you would like to have the interview at. What did your fiance write? That's the consulate where you need to go.

3) your fiance will have to send you I-134 with evidence of support (letter from employer, pay stubs, assets etc.), original papers (divorce decrees, birth certificate)and a renewed letter of intent. Then, you gather proofs of ongoing relationship (passport stamps, boarding passes, photos, emails, chat logs...anything that links you two together, fill out the needed forms, get your medical exam done when packet 3 arrives and get a police clearance from every place you lived in for more than 1 year.

On July 26, 2010, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). I did not get a interview. This update is a post decision update. So I don't think I will have an interview as they have already approved this petition.

Ok, either I am confused and/or reading you wrong, or you're confused on the process. You've received notice that your I-129F original submission was approved, which is the first step of many in the process of actually getting a Visa. There is no interview for that stage. The only interview will take place at the end of the process, once all documents have been submitted and a medical exam has taken place. Perhaps you should review the flowchart that VJ provides?

NVC will forward your file to the Consulate that your fiance stated in the I-129F. Once the file gets there, the Consulate will send you packet 3, containing instructions and forms that need to be filled out. That's how they contact you. You can contact the Consulate if you want to, call them and check if your file got there, but you have to wait the packet 3 from them.

Following their instructions, you will send back what they ask you to and either wait for packet 4 OR you call the Consulate for an interview appointment (procedures are not the same with all Consulates). You WILL have an interview! In the meantime you need to get your medical, police report etc. You will bring these with you at the interview! You will also bring the I-134 form, affidavit of support filled out by the US petitioner and supporting evidence for it. It doesn't matter if you guys sent that form already at USCIS with the I-129F. You have to have one with you at the interview!

Bring everything I mentioned at no.3 in my previous post with you at the interview! It doesn't matter what they have already. Take with you all proof you can get. Your I-129F was approved, but it is not a visa. You still need to convince the consular officers of your bonafide AND ONGOING relationship...
