Canadian with TN married a US citizen - should I change my name

Hey there everyone,

I really need your help and advice as you've greatly assisted me in the past. I am now married to my US citizen husband and will start filling out the AOS to change my status. Should I go to the secretary of state first and change my name to his name and follow with the process? Or should I keep my maiden name and start this process?

What should I do first?

I have a Michigan Driver's License in my maiden name

I have a Social Security number in my maiden name

I have a Canadian Passport with stamped I-94 in my maiden name

Should I change my name and then start filling out the paper work or no?

Please help...Thanks everyone.

You don't need to go to Secretary of State for a name change. If you want to take on your married last name, then take your marriage certificate to the DMV, SS office and present the certificate. Apply for new cards with your new name. I'm trusting that your marriage certificate has your new married name on it? If you want, you can go to the Canadian Consulate and apply for a new passport with your married name.. or you can wait on that. However you complete your AOS forms, is the name that will be on your GC. I filled my forms with my new hyphenated name even tho my documents all have my maiden name on them...

07-23-10 CHECK$ CA$HED!!!!! So happy to see money leave my bank account!!!!

07-24-10 NOA received in the mail for AOS/EAD and hubby received AP for me :)

07-26-10 TOUCHED!!!

08-06-10 EAD & Alien Petition TOUCHED!!!

08-24-10 Service request submitted for Biometrics Letter.. waiting, waiting...

09-01-10 2nd service request call put in - Dallas ASC backed up and everything is on hold! :(

09-03-10 Infopass appointment set for September 17th

09-03-10 EAD TOUCHED!!! I might not need my Infopass appt. after all!

09-07-10 Another touch for EAD

09-08-10 EAD TOUCH again! woo hoo!

09-17-10 InfoPas appt @9am. EAD APPROVED on Sept 2.. but still waiting for biometrics

09-20-10 3rd service request to USCIS, escalated to IO. still no bio appt

09-28-10 AP sent to Chicago Lockbox

09-29-10 4th service request to USCIS, useless convo with IO

09-30-10 AP received and signed by USCIS, J.Chyba

10-04-10 Another useless convo with IO

10-06-10 Letter sent to Congressman

10-10-10 Letter sent to Senator

10-11-10 AP Touch

10-13-10 Email received, AP approved :)

10-15-10 Useless SECOND Infopass appt. and useless AP without biometrics

10-16-10 I-512L AP Doc arrived in the mail

10-18-10 Another USELESS call to USCIS

10-19-10 Got my biometrics appt for Nov 3rd!!! early walk in complete 10-20 *SEE ABOUT ME PAGE FOR MORE TIMELINE INFO!*

At this time I dont want to go back to Canada because I am here on a TN and entering back the US and showing as married they could deny me entry saying that I am intending on being a perminant resident when the type of visa I have does not allow. SO i prefer not to go through the borders until my green card is in hand.

I am just not sure if changing my last name will complicate anything considering I have a TN right now.

please help

Just do what the majority of K1 visa holders have to do and wait till we get the GC to change our names. That way you don't have issues. i have a GC now but I still haven't changed anything over except my bank account stuff and the health insurance was obtained in my married name. Still have to change my SSN, passport, drivers licence and all other Aussie stuff.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Adjustment of Status from Work, Student, & Tourist Visas" as you are adjusting from a a visa other than a K1, K2, K3 & K4 which the prior forum is for**
