Obtaining domicile after sending in DS-230 form and checklist

Hi folks,

New to the forum here. How's it going?

My wife and I are currently at the point in our green card process where we need to mail in the DS-230 form along with a checklist specifying that we have obtained all the required documentation. Yet it is my understanding that you do not to actually send in the documentation and only need it for the interview (which would be several months later). My wife and I currently still both reside here in Canada and would essentially need to find and pay for a place of residence for several months while still living and paying for our residence in Canada. It seems like somewhat of a waste of finances. I'm wondering if anyone has simply obtained domicile after they sent in the DS-230 form and checklist but before the interview (maybe a month before). This would greatly cut down on costs and you wouldn't need to pay for two residences in two different countries nearly as long of a time. Is there any reason one cannot do this?

I'm terribly sorry if this sounds like a stupid plan, but the alternative seems quite costly for a couple residing outside of the U.S. until the one officially obtains a green card.

it's my understanding that 'proof of domicile' is shown/proved-up on interview day.

For China filers - usually the USC will leave China AFTER the DS-230 has been accepted, wrangle a bit in the USA, return to China prior to interview day - and THAT'S OK - no 'ding' on 'duration of foreign residence' at all.

Hi there,

I think what Tom is referring to is the checklist that you must submit along with the DS-230 before an interview is scheduled. The checklist includes a space for evidence of domicile. It seems like you would need to obtain it before the DS-230 form is sent in. Anyways, i've been wondering the same thing - do you need proof of domicile when you send in the DS-230 form or when you actually come in for the interview. If it's when you come in for the interview, then the wording of the checklist seems a tad confusing.

This is a common issue for Canadians as Montreal is strict on the domicile/re-establishing domicile in the US. There is even a pinned topic in the Canada forum

Typically it will need to be presented at the time of the interview. Best to get all of this stuff done and out of the way (even if it is a 'waste of finances' because you could be delayed months)

Although i'm not sure if my question has been answered - it's probably the way i'm asking it.

I fully intend to establish domicile by the interview date but am wondering if I can do it after I send in the DS-230 form and checklist. I guess my official question is: am I allowed to do this?

Hi Shimmer,

There is no reason why you can't re-establish domicile after you've sent in the DS-230. In fact, you may as well wait until then, because it will most likely be a few months before you get an interview, so you can build up evidence of domicile during that time - pay stubs, car loan, rental agreement, etc. You don't have to provide evidence until the interview, so go ahead and send in the 230. Keep in mind you will have checked off the 'medical' as well, although you can't even schedule that appointment until you've got your interview letter. :)

Well this is surprisingly encouraging news!

I thought my husband and myself would have to find a place months and months in advance to our interview. And after hearing the wait that people have been having in the thread birdnerd mentioned, it became a little more depressing.

And shimmer, thanks for asking the question that I couldn`t seem to find the words to ask.
