Hello,

I am new to this site and so a little bit confused. I have submitted all my application through my lawyer.

I am a US citizen and my wife is from India. We got married in March and i got my I-797C notice date on the form is April 29.

I am wondering what would be the next step in this process.

My lawyers have said that it take more than 7 months to get IR1/CR1 but i wanted to see if anybody has got a correct time line for getting this IR1/CR1.

Thanks,

You probably didn't need a lawyer for this. But hey, it's your money. You should get your USCIS approval in about 5/6 months. That's the official stance. But in reality people have been getting their USCIS approval in about 2/3 months. But recently it slowed down a bit so. It's more like 3/4 months now. Once you get that you will have to dance through the NVC, which should probably not take more than another 2/3 months if everything is set. VSC is slower than CSC. So yours might take a bit longer than what I'm estimating.

N400 CITIZENSHIP STAGE

23-DEC-2016 -:- N400 form mailed to Dallas, TX Lockbox (USPS EXPRESS)

04-JAN-2017 -:- N400 form received per NOA1

09-JAN-2017 -:- N400 form NOA1 notice date

14-JAN-2017 -:- N400 form NOA1 on hand through USPS

30-JAN-2017 -:- N400 fingerprint taken

01-FEB-2017 -:- N400 interview schedule process started

26-JUL-2017 -:- N400 interview date set (01SEP2017)

29-JUL-2017 -:- N400 interview letter on hand

Thanks for your immediate reply.

I have the following questions -

1. Does USCIS approval mean NOA1 and NVC approval mean NOA2?

2. Is I-797C, which i has a notice date of April 29, mean NOA1?

Again thanks for this information

No, the NOA1 is acknowledgement of the receipt of your petition by USCIS; the NOA2 is the approval notice of your petition at USCIS.

NOA-1 = Notice of Action Form I-797C (Receipt Notice)

NOA-2 = Notice of Action Form I-797C (Approval Notice)

Thanks,

if there are no complications in your case, then you could have done it all yourself rather than a lawyer. Lots of folks found lots of problems when they used lawyers. in any case, i think the lawyer's time line is about right. while lot of folks are getting their uscis approval in an avg of 3-4 months, it took me 5 months and 10 days to get mine (ie for my wife). then another 3 months thru the NVC and the interview. so total time for us was 8.5 months. nowadays i'm noticing that its taking 2-3 months; i hope it is short for you. you can check the time it takes these days in the processing times link on the top panel. good luck
