What current income to enter on Item# 23 of 1-864

What current income to enter on Item# 23 of 1-864? On my brother 2009 W2 his annual income was $105,290. Is that supposed to be on item#23 as his current annual individual income? Pls help.............. :crying:

04/08/2007 to 05/2007- Getting to know each other

06/2007 onward - long distance relationship went so well

(chat, email and calls,)

01/2008 - My husband proposed to get married and I accepted it and planned/scheduled to meet me in person

09/04/2008 - He left the States for me

09/06/2008 - I picked him up on the terminal 2 airport

10/08/2008 - We got married

01/29/2010 - Filed 1-130

04/12/2010 - 1-130 got approved

06/21-22 - Medical examination at St. Luke PASSED!!!

07/01/2010 - Interview PASSED! Love you Lord!!!!![/color][/size]

07/10/2010 - Arrived at AL USA with my husband

(POE- Dallas Forthworth Texas)

07/27/ and 08/03- Got 2 Welcome Letters

08/13/2010 - Got my GC [/size][/color]

04/26/12 - Submitted ROC documents

05/11/12 - Biometrics

12/26/12 - RFE

12/31/12 - Responded to RFE

Current annual income is what he is projecting to make this year based on past history like W2 or averaging the pay stubs.. and that can be provided with a letter from employer stating his projected annual income for this year also Make sure in section 25 you put TOTAL INCOME from line 22 of your 1040 or your W2 for this correct year or years

Does It sounds like either way, enter the total income from 2009 W2 or enter the estimated or expected income this year and provide paystubs and cert employment? Here what it says on 1-864 #23:

Enter your current individual earned or retirement annualincome that you are using to meet the requirements of thisform and indicate the total on this line.You may include evidence supporting your claim about yourexpected income for the current year if you believe thatsubmitting this evidence will help you establish ability tomaintain sufficient income. You are not required to submitthis evidence, however, unless specifically instructed to doso by a Government official. For example, you may includea recent letter from your employer, showing your employer'saddress and telephone number, and indicating your annualsalary. You may also provide pay stub(s) showing yourincome for the previous six months. If your claimed incomeincludes alimony, child support, dividend or interest income,or income from any other source, you may also includeevidence of that income.

Enter your current individual earned or retirement annualincome that you are using to meet the requirements of thisform and indicate the total on this line.

It's as Ronald and Elvira said. Item 23 is his expected income for this year, 2010.

Ok thanks a lot....really confused what to do thanks for your help. I asked my brother why he enter $106 on 23 and he said that includes overtime and it shows overtimes on his payslip. Because on his cert. employment base annual is $93 he said thats without overtime
