Not a direct response to the OP's question, but my wife was informed that her Maryland DL would be valid for as long as her lawful presence determined via Homeland Security's database. She presently has the two year GC, but when the license was issued, it had a normal five year validity. Though they were strict on some points e.g. the DL could only be issued under SS card's name, regardless of marriage certificate, GC etc., they seem inconsistent with others.

I wonder if VA runs a similar check through the Homeland Security database and determines eligibility based on those results. If so, they may not be able to issue a new DL based on filing status via NOA1.

All the best to you!

The whole DL renewal confuses me..I'm in South carolina and was given a five year license...now I'm worried that technically my license is not valid..

I would suggest you check your local DMV's website to see what documents are acceptable. I don't see why you won't be allowed to renew it. Your NOA clearly states that your residency is extended for a year so that should be easy call for anybody but then again these are DMV employees we're talking about. Half the time they don't even know where they are or what they are doing. Check the website and print out the acceptable documents and take it along with your expired green card and the NOA to cover all bases.

In New York, it doesn't seem like they distinguish between conditional permanent resident and regular permanent resident. I passed my road test and got my DL with the regular expiration date even though my GC expires in Oct. I'm pretty sure all DMVs connect to the USCIS in some way once you present a GC or any document from DHS/USCIS. So even though DMV personel might make a fuss just ask to speak to a supervisor.

Thank you all for your responses. Well, i did make a trip to the nearest DMV office and my DL was renewed (payed only 8 dollars) for a year as per the NoA1. The lady who assisted me at the DMV told me that, once i get the 10 year greencard i will have to make another trip to DMV, but i will just wait until the 1 year expires, since the wait at DMV is just too long. At the mean time am waiting for approval on my ROC. I also took a copy of the NOA1 to the college i go to and my place of work.
