EAD production ordered June 16

EAD = Employment Authorization Document

The EAD for my wife was approved yesterday (June 16), along with the AP document which was mailed.

She will be traveling to Thailand roughly two weeks from now, but will return just before our AOS interview July 20.

How long does it take for the EAD to be produced & mailed?

The email notice said one month to be pessimistic, but what has been the actual experience?

The reason for asking is because I would like her to apply for the SSN before she goes to Thailand if possible.

I know she can get that with the EAD document, but since we have to wait an undetermined time,

could we ask for the EAD document if we already have an infopass appointment set up for June 24?

I kind of doubt it because this isn't an emergency, but the IRS needs her SSN for the 2009 tax filing

which was already sent.

Did you file your taxes concurrently? Is that why they need her SSN?

My experience was 12 days (including weekends) from approval. 6 days for AP.

Problem is: even if you get EAD in 10 days, they will most likely not have it "registered"yet is you take it to the SS office. Basically it won't be in the system. I think in our March forum and April forum there are some people going through that hassle. So it looks like you might be able to apply if EAD gets there soon and is in the system after a few days only- but it then takes an extra 15 days to get the actual card (the give you a receipt that shows you have applied, but it doesn't have the number yet).

So...looks like she might be lucky and apply before she leaves, and you will get her SSN in the mail, or she might have to wait until she comes back depending on how quickly you get EAD. I think the infopass will not help in any case since the EAD card needs to be printed just like the GC...what a waste since I got mine 2 days before the interview and will barely ne using it at this point!

Congrats nontheless on solving most of the problems you seemed to have last week with the trip to Thailand, the interview letter not showing up and all that

Did you file your taxes concurrently? Is that why they need her SSN?

The taxes were filed jointly but I left the SSN for her blank.

What I had to get from the SSA was a letter explaining that she wasn't eligible for an SSN at that point in time.

I presented it to the IRS along with a form requesting a "temporary tax ID."

I haven't heard from the IRS since we filed, but when the EAD comes in or she gets the GC she can apply for

the SSN and then I'll just notify the IRS of that and they will apply it to my 2009 taxes.

I don't think they can force me to re-file as single if I ultimately send them her SSN.

I don't really expect to get the EAD in time for her to request the SSN. I'm guessing we can do that when she returns.

So it looks like you might be able to apply if EAD gets there soon and is in the system after a few days only-

but it then takes an extra 15 days to get the actual card (the give you a receipt that shows you have applied,

Agreed.

...what a waste since I got mine 2 days before the interview and will barely be using it at this point!

Agreed; we may duplicate that experience.

For us, EAD came in the mail 8 days from the approval email from USCIS, the AP came 5 days from approval. This was all in March.

We got an SSN 2 weeks after my wife arrive on the K-1 so had it for 2009 tax filing. Paying taxes as a single all year and then filing married was a nice bonus on the tax refund. They rejected the filing though until I used her maiden name on it. We still haven't gotten around to getting the name changed on her social security card yet.

If she gets the EAD in around 8 days that will be great,

to hope for a successful SSN application before she

goes to Thailand. It's great having a wedding anniversary

on New Year's Eve as it's impossible to forget yes.gif

Did the IRS reject the taxes you filed or the SSA?

I'm guessing it's the latter. They're all smiles

when they are taking your application but they

love to find excuses to reject it later.

I e-filed and that got rejected until I changed to her maiden name (which her SSN was in since it was before we were married). Was no big deal to fix.

I had to include a W-7 form to request a tax ID number for her in her married name (which was OK because

she changed her name. along with that I sent the letter from the SSA saying she couldn't get an SSN just yet).

Ha Ha

I sent it to Holtsville, NY which is where I send my taxes every year.

Three months later I got a letter saying thank you for your W-7 filing, but it should have gone to Austin Texas, because that's where

all returns with W-7 forms go...naturally the filing will be considered LATE even if I mailed it out before April 15.

Don't you love govt. red tape and how it strangles you like an anaconda?

You'll need the EAD and after applying, it will take SSA another 10-15 days to get the SSN to her. Sounds like the SSN won't be available in time, if she is leaving so soon. Meanwhile, I assume the IRS is processing the return and using her TIN...that's OK.

Yes, the IRS was SO GOOD as to forward the return from Holtsville to Austin.

We don't expect any problems with that, with the exception of an annoying late filing penalty.

We're not worried so much about the EAD as it may come after she's gone to Thailand (the earliest June 27).

It should be there by the time she comes back on July 17 or so.

We fully expect to get the AP document this week; if there is any glitch we have an infopass meeting set for June 24.

She needs the AP document before we buy the ticket because if by some foul-up she doesn't get it, we'll be

holding the bag for travel that she can't do.

Wow, what a pain in the a%$ for filing. We have to waste another morning at the Social Security office to get the name change taken care of sometime soon.

We wasted about a total of 3-4 days at the SSA as well but not going back until

we have a document (EAD or GC) that they can process and have assurance

that her status is in the computer (or else they might ignore the document!).

B-) We still haven't got her AP document and this marks 5 business days

since it should have been mailed. Hope it comes today; can't buy her

ticket until the AP is "bagged & tagged!"

Best of luck to you too.

I know "results may vary" but as of Thursday it will be 8 days.

I was hoping to get a ticket for her as soon as possible but

we'll have to be patient. She needs to be back for the interview

on July 20 so there is very little wiggle room. I don't expect her

When was your last touch on AP? I know it seems these updates are not reliable but for my AP and Welcome notice, the last touch corresponded to the postmark date.

Come on USPS! Are you keeping an eye on the flights? I know with some websites you have 24 to cancel without fees or penalties, but it's probably better to wait.

Good luck!
