Hi all,

I'm new memeber on VJ. It's so nice to make friends here.

I found that VJ is so helpful to people. I have one question as the below:

I met my fiance on the matching webisite 3 years ago. He came to Vietnam to see me one times and gonna make plan to visist me when I'm scheduled for the interview. But I have no idea when it is. On May-28-2010, my fiance received the RFE that he was told to be presented at biometrics screeing on June-03. And he was done that yesterday ( fingerprint and handwriting sample) I think the reason that he had to go there because of his criminal background. But we read on I-129F Instruction form, my fiance isn't on the list of violent criminal and there's nothing of his background. So we have no idea how long they will approve or cancel. It makes me really worried. Is there any case as similiar as us? Or anyone give me advices?

Hard to say without knowing what it is that he had a problem with in the past.

You should be aware that the HCMC consulate is a very tough one. As Kevin and Tuyen said, continue to build and grow your relationship.

Right now he should focus in the RFE with the USCIS and get past that.

Have you had an engagement ceremony? Two visits is doable but may be very difficult. If it is possible for him to slip in another visit and have an engagement ceremony it would definately strengthed your case at HCMC for interview time.

Hard to say without knowing what it is that he had a problem with in the past.

You should be aware that the HCMC consulate is a very tough one. As Kevin and Tuyen said, continue to build and grow your relationship.

Right now he should focus in the RFE with the USCIS and get past that.

Yes, you are right. HCM Consulate is a very tough one. A lot of couples have got blue slip for the interview .

Actually, we celebrated my birthday along with my engagement party because my fiance had limited time in VN. Also, I wanted to save money for him. But the one of the most problem is that we didnt celebrated it as culture VN tradition. I'm afraid that Consulate will make it hard. But we have a faith. No matter what happens, we won't give it up.

Your fiance should visit you at least one more time before the interview . HCMC consulate is very tough and anything that doesn't follow VN tradition is looked at very close for visa fraud.

By trying to save money not having a traditional engagement party, you might have made it more expensive. Tuyen and I didn't have a traditional Dam Hoi and marriage. It ended up costing more than if we would have taken the time do everything the traditional way.

Don't rush and take the advice from members that have going through HCMC. If you and your SO are unsure :unsure: about the whole process, you can always hire an attorney. If you do retain one, make sure the attorney is a member of the American Immigration Lawyers Association.

Take this advice from someone who has had difficulty getting K1 visa for my fiance. If I had to do it all over again then I would have gotten married This is more proof of a relationship. If you go to the interview and fail (like my fiance did) you are in for a world of delay and will have to refile and you won't get a second interview for at least 1 year. Right now you need to do the following: webcam chat both of you need to print the conversation, he needs to make a copy of his phone bill and send you a copy every month with calls to and from, write each other EVERY week I know the mail in Vietnam may not be reliable and some may not get to you keep the envelopes with the postage for this is written proof I would say you need 30 letters to and from for each, If he comes to Vietnam make copies of plane tickets and his travel visa, Just a stub from plane ticket is not enough. Please treat this interview like it is a trial for your LIFE and you need to have overwhelming evidence of your relationship. When he comes to Vietnam go take your picture in front of US consulate pictures must provide date so get a camera that puts the date on the photos. If you get a hotel room get them to put both your names on the register and give you this in writing. If you read all these posts from others you will see the stupid questions they ask at interview and they will ask you things that have nothing to do with 2 people in love such as Give the names of some of his friends, Where and what date will you take hooneymoon, fully describe his job,livelyhood, and family, when did he graduate high school, etc. I know you want to save money but lawyers will tell you the K1 visa is easier and faster to get but the K3 spouse is more definate proof of relationship plus he can claim you as a dependant on his taxes. I do not wish to scare you but please realize if the consular officer finds the smallest weak link in your evidence of a relationship they will do the easy thing and decline you. And the only way to get a second chance is to refile or do a rebuttal both of which will take in excess of a year. GOOD LUCK

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

But his criminal background isn't not on the list of I-129F instructions form and do need a waiver.

Yeah, you are right. The biomtrics will delay the case longer than we expect. I don't know how long, maybe a year or so.

No matter how long it is, I still wait and I hope everything will go through.

BTW, I'm still so happy to make new friends here and found many helpful guides.

Dear All,

I gonna cry inside so much. I found the my fiance falls under AWA. 10 years ago, he downloaded many kind of underage child porngraphy. He was convicted 2002 and he will be out of the sex offense list one more year.The charge for that was complete. He tolly rehabilitate now. He's got 2 kids and he treats them so well. Besides, he got 2.D.U.I. I'm really so worried. After 4 months since NOA1, we received biomtrics app. I know that our case processing will delay longer . I found some cases which are similiar as us that the processing has been lasting in 1 year without receiving NOA2.

I know it's a hard battle for us right now. All we can do is to get over the problem and won't be scared AWA. But I'm still scared of it. I have cried all the time. I don't know what to do. Do we need to wait until they finish the result of fingerprint and send us RFE OR NOID? Or during this time, we can submit of evidene rehabilititon? Is it ok? Should we hire an Immigrant attorney? It's so hard to look for a lawyer who knows about AWA clearly?

The US Immigrant gonna give us hard tough. That is a very rough challenge. Should my fiance contact with Congressman or Senator to get thier advices in this case? Pls help me out! I'm so melancholy right now. We have been waiting so long since our meetin in person. Right now, I'm unemployed. I feel the word is turning back on me. sad.gif .

Hello Tanni,

It is hard to predict what will happen. Any conviction involving underage children can mark a man for life, but anyway he was not charged with molestation. He was not too smart to be downloading such porn, was he? Do you know if his petition made it clear that he has these convictions?

He does need to visit you again soon, to demonstrate that this relationship is serious and important to him.

Once they obtain his biometics, the FBI can search for information on any other crimes he may have committed. That will take at least one month, maybe more, because the FBI doesn't have enough staff to do all of its assignments like this one. Then USCIS will take two or three more months to decide what to do. Maybe you should plan to wait at least one year for your interview, but maybe it will happen sooner.
