wrong date of birth on EAD card

I received my EAD card in the mail a couple of days ago. I noticed right away that my date of birth was wrong but I wasn't too concerned about it... until yesterday when I went to the SSA (Social Security Administration)to change my name in my SS card. The SS officer told me there might be a problem if the infos in their system dont match but she accepted my application to change name and told me to wait in the mail on what to do next.

I came home and looked at the copies that I made before I sent out my AOS package and I found out that it was an error on my part. I called the USCIS hotline and asked if there is anything that I can do about it. They told me that if it was USCIS's mistake, i can re-file at no cost but if it was my mistake, I could still re-file but I have to pay the fee ($340) but the process, nevertheless, would still be the same as filing all over again, 90 days and all.

I am caught in a limbo. I dont want to pay $340 and then find out that my AOS is approved tomorrow or in the next days BUT then again, there is no guarantee when the AOS will really get approved. The good news is, I filled out my AOS forms correctly. I thought about getting an infopass and ask how I can go about to at least have my DOB changed in the system file. Oh gosh, I dont know.

Personally my solution would be this: Your AOS papers are correct. SO if you get the GC with the information incorrect, you can:

- show them where on your paperwork it says your birthdate (this is the most impt proof)

- show them your passport

- show them your birth certificate (a copy of which you SENT)

therefore getting a free replacement GC at THEIR cost because it's now their error because they didn't follow the AOS paperwork and you have the evidence.

You should get your GC soon enough so there's no need to bother fixing the EAD.

That's what i'd do anyway. Good luck!

Ur right. I guess my GC is coming in the mail soon. I received the approval email last night! Thanks for taking taking time to reply!
