The I-797C (Notice of Action) is usually issued when you apply for adjustment of status (AOS) for permanent residency.

The I-797 (first Notice of Action) for the I-129F Petition is usually issued after the petition is received by USCIS (can be as soon as 4-5 business days).

* greater than 1 month seems a little long.

* did you send the package "return receipt"?

* have you checked with your bank to see if the fee was cashed?

It took USCIS 5 days to send an answer to us. I would call to check status, also did you setup a proflie on their website so you can get updates on your case through your email address. You can check the status of your case once you setup your profile there on the website of USCIS.

You can sign up to check or case status here ---->https://egov.uscis.gov/cris/jsps/selectusertype.jsp

BUT only when you receive your first NOA... you need the receipt number in order to check status.

alright thanks a lot to everybody for ur fast reponses really I appreciated I wanna clarify something about my case it sound a little bit wierd.

1.until now its about 5weeks sence we sent the packaqge for I129F.

2.badly we didnt use the "return receipt".

3. we cant check the chek number that was cached by because we used a Money Order.

so its not possible actually to sign up on uscis website to get the case status because we have no NOA1 number.

Well one month seems like alot, most of the people here on vj get the first NOA by the first week after sending the packet, I would call uscis because you cannot get information about your case through the uscis website because you need a receipt number and the receipt number is going to be on your NOA, i also called uscis just to see if they have gotten my packet and they told me that uscis has up to 45 days to issue the first NOA and there was nothing i can do untill i get the first noa or the 45 days are up.

hope this helps and i hope you get it soon.
