My fiance's uncle has been living here illegally for about 3-4 years.

We do not know where he is, just that he has not returned to his home and is living in USA.

When my fiance goes for his K-1 Visa interview, are they going to ask him if he has relatives in the USA?

If his parents apply for a visitor visa to come and attend our wedding, will they be asked if they have relatives in the USA?

We do not know where he lives, just general area, like he lives in the southeast.

Please give us your impression of what problems we will run into.

Obviously we cannot lie but wonder if this will even be asked in the K-1 interview?

We have read on Visa Journey that other parents who want to visit the USA were asked if they had other relatives who lived in USA so we need to be sure to know what will be asked (likely, not expecting anyone here to have perfect knowledge, just does this question get asked in K-1 interview?)

Before the interview you need to fill the DS-156 form (among other forms). I don't know if you did that already as you don't have a timeline on this site.

On the DS-156 question #37 they ask about relatives in the US. Though they only ask about husband/wife, fiancé(e), Father/mother, son/daughter and brother/sister. They don't mention uncle/aunt. So if they don't ask it on the form I don't think they would ask it on the interview.

On the other hand, if his parents want to come and they need a visa (if the country is not under the VWP) they would have to fill the DS-156 form too. And this can be a problem as your fiancé's uncle is one of his parents' brother (correct me if i got this wrong) and they ask for brother relatives and their status.

You're right, it's the brother of his dad.

Do you know of anyone being denied a visa (Visitor or K-1) because they had an illegal relative here in USA, NOT that the person petitioning were *ever* here illegally but there was a relative existing who was here illegally?

My fiance doesn't even like this uncle, we are DEFINITELY not inviting him to the wedding or having anything to do with him in the future. We won't even live in the same area of the country. We're just nervous as we don't want them to think any of us are going to do something illegal, just because the uncle has refused to go back. This is a case of the "black sheep" being the Uncle and the rest of the family not wanting to suffer because of that bad reputation.

I was asked this question in all 3 of my visa interviews. (B2, F1, CR-1)

As long as your fiance answers honestly, he shouldn't have a problem.

Your FIL though, it could be an issue.

As others had said, it probably will cause some questions on your interview but shouldn't slow it up really , unless you two meant because of the uncle which may result in more checks. However it probably means the father isn't going to get a visitors visa as they will worry that he will "disappear" like his brother did. Depending on the consulate visistors visas are denied for small reasons so I wouldn't count on parents attending the wedding.

This will not be over quickly. You will not enjoy this.
