As we are all aware, the K1 petition approval is valid for a certain timeframe., if your embassy sets an appointment date out of the validity window, who does the burden fall on to extend it the validity, or does it make any difference once you get an interview date, the validity of the K1 goes out of the window..its a bit technical to my shallow mind so please keep your recommendations coming in..an example is my case was approved on Feb 24th, the interview is set for Oct 14th but the approval on the NOA2 expires June 23..

Great question.. I was wondering the same... it's been month since Consulate have received our packet 3, but still no interview letter/date yet as of today... I guess is that I probably won't get anything back until end of June which by then expired base on NOA#2.

So calling out to all VJ w/ experience to help us answer this questions and shed some light to ease my worries and pain. :bonk: :bonk:

The validity of the approved petition can expire, but the consulate will almost always extend the validity automatically, as long as there is activity on the case or any delays are because of the consulate. Some examples of when the validity might be allowed to expire are if the applicant doesn't respond to packet 3, or doesn't show up for the scheduled interview, and the consulate doesn't hear from the applicant or petitioner.

If you are concerned that the validity of your petition approval might expire then you can usually contact the consulate and ask that the validity be extended. For example, if you aren't going to be able to get your packet 3 documents submitted before the petition expires, it would be good to let them know so they don't think you've abandoned the application.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Are you saying that packet3 have to be at the consulate before the expiration of the NOA2?

APRIL 8,2009 - Returned to USA

FEBRUARY 10,2010 - I-129F sent to Vermont

FEBRUARY 16,2010 - Received NOA 1 ( Hard Copy)

NONE- RFE received

MAY 21,2010 - Touched

Are you saying that packet3 have to be at the consulate before the expiration of the NOA2?

I'm saying it's up to the consulate. If they receive the petition and send out packet 3, but don't hear anything from either the beneficiary or the petitioner before the petition expires, then they can consider the petition to have been abandoned. This is precisely why the petition approval has an explicit expiration date - so the consulate isn't forced to wait indefinitely for the beneficiary to respond.

If you can't get the packet back to the consulate before the petition expires, then you might want to contact the consulate and ask that the validity of the petition approval be extended. An email is usually enough. As long as they know that you haven't abandoned the petition, and that the beneficiary still intends to apply for a visa, they'll usually extend the validity. There is a limit to how long they'll continue to do this. 1 year is typical.
