D. Other information

1. If separate petitions are also being submitted for other relatives, give names of each and relationship.

We are getting ready to mail in our I-130 application. I am confused on this question. I have two children, 20 and 15. Do we have to submit an I-130 for both of them at this time as well? Or do you somehow file for children at a later date when I've been approved for my visa? How/When do you apply for my children?

Thanks

p.s. I am the Canadian, my husband is the USC.

Yes, but - that 20 year old has some 'age out' issues. You might want to check into that.

USUALLY, for children, file seperate I-130, at the same time, with the foreign spouse's I-130, in the same mailer packet, into USCIS.

It is possible to file later, but is such a pain-in-the-@ss so to do.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Yes you would file an I-130 for the 15 year old but the 20 year old is out of luck because the marriage took place after the 18th birthday. The I-130 is a petition, not an application.
