Heya guys, i have a slight problem, looking for some advice.

I am about to file for AOS, however, they are saying I need to take a new medical, but when I had my medical in London (nov'09) I passed fully and was given No Class.

Does anyone know what part of the new medical form I have to fill in for the AOS, as a civil surgeon wants to charge me $350 for a full new medical and do all my vaccinations again, some of which i cant have as im allergic to the actual vaccine.

This is from the "guides":

I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. Regardless of if you are exempt from a medical exam, you are still required to complete certain portions of the I-693 and have a Civil Surgeon certify the form (and seal it in an evelope). Specifically, you will complete Part 1 (Information about you) of the I-693 and provide both the form and your DS-3025 (if you have it, proving your vaccination history) and any proof of required vaccinations that were completed prior to entering the US. If you do not have a copy of your DS-3025 you will need to provide sufficient evidence of your vaccination history to the Civil Surgeon (talk to the civil surgeon's office to discuss what vaccination records they accept as proof). If you do not have proof of your vaccination history the Civil Surgeon may insist on re-administering all the required vaccinations prior to completing the I-693. Once the Civil Surgeon has has verified that all required vaccinations have been performed, they will complete form I-693 Part 2 (the vaccination section) and Part 5 (the Civil Surgeon's Certification). They will then seal the form in an envelope and return it to you.

I would also call around and get price quotes from other CS's. You don't need duplicate vaccinations.

Some (or many) civil surgeons do not understand the exception to the medical for "K" adjustees...

The civil surgeon only needs prepare Part II Item 5 of the I-693

Who is saying you need a new medical exam? K visas are excempt from a medica exam if they had one overseas within 12 moths of filing the AOS. Unless you have filed and have an RFE for a new medical, you do not need one. You should send in the DS-3025 vaccination supplement form you should have received at the medical exam in London.

You are very kind, Payxibka. Most civil surgeons understand completely and fully that K visa holders do not need another medical exam, they want the $350. Many simply refuse to do anything unless they charge for a full exam. If the OP has lucked onto one of these, she should call around and find one who isn't trying to rip people off.

The problem I have is that their is only 1 CS in my town, then its a 4 hour drive to the nearest other one.

I wasnt given a DS-3025 so where do I go from here?

Try contacting the doctor who did your K1 exam to get a copy. Have you searched for a CS on the USCIS website? You might have to shell out the money then if that's the only CS but try show him proof that you already had the K1 exam.

the better avenue is to provide the CS with the regs on the "K" exception

Concur - I actually had to do that with my CS - wanted to do more...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

UPDATE:

Ok so i have now got the form DS-3025 which shows that I have had the MMR last year and the rest are ticked in the N/A collum. Where do I go from here, do I still need to get a CS to fill out anything on the I693 etc????

Yes you need a CS. You might need some other vaccinations depending on your age.

You still need a CS to sign off on the I-693. The CS would only have to transcribe your vaccinations to the worksheet. Some CS's will just charge a nominal fee for the transcribing BUT in most cases want to collect on the visit. If there is only 1 CS in your town most likely he/she is cashing in on it. Some people have mailed in only the DS-3025 and never received an RFE however if you want to take that chance and they issue a RFE then there could be a delay in processing your AOS.
