My fiance and I were planning on getting married this month during his leave from deployment in Iraq, however the army being the army messed this up by moving his R&R dates forward by a month to a time when we were financially unprepared for me to fly over there for it. So there went that idea along with hopes of getting a military expadite.

We are now looking at me going over in Oct once he returns from Iraq, getting married soon after I arrive and me staying the full 90 days I am able on the Visa waiver as we will have not seen each other in over a year. Once I return to Australia in Jan we will start the CR-1 process.

My question is how many times am I able to visit him on a visa waiver while we wait for my visa? And how long is the average time for all this to take? Can we start the process while I am in the US (with me intending to leave after my 90 days is up)??

Congrats on the upcoming wedding! Have you thought about a K-1 with a military expedite? That way you can file the peition sooner and hopfully be in the US quicker

If that is not possible, you can file the Cr-1 when you are still in the US and return to Aus. at the end of the 90 days. There is no limit to visits. The CBP like to see you spending more time in your home country than in the US. Also, if they presume you have immigrant intent, or not strong enough ties to your home country then they can deny you on your first visit or your 4th. You should be prepared to bring ties to your home country with each visit to show that you intend to return.

This process can take anywhere from 6 - 10 months

well congrats on the wedding, but too bad it has to move. Dont worry, you probably can still get a military expedite. our case got expedited even after I returned. At worst, your soon to be husband can get a letter from his commander stating he needs him focused on his job...not the visa process.

I wish I could have had Mhay come visit while waiting for the visa, but of course there is no VWP from the PI. Good luck to you guys!

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.
