First of all, I want to say thank you to my friend who told me about this website. That's why I am here now. :)

Secondly, I have a big problem but I don't know how to deal with it and I hope someone here who has experience with this situation can give me some advices what I should do. I will be grateful for your help.

Back to a few years ago (2006), my wife had a boyfriend (he is USC) and their relationship kept going until Jan 2007. My wife found out that the man she loved was unfaithful, he had another girl (sound familiar :)). When my wife caught him cheating, she broke up with him immediately (she didn't believe that guys are gonna change when they got caught of cheating :)) and they stopped contacting from that day (my wife changed her phone number and got her job at another place.)

A few days ago, he met my wife on the internet (some one gave him her yahoo nickname), they had a short chitchat and he asked about our family (he knew we are married) then he told my wife that after the time they broke up, he tried to look for my wife because he wanted to keep the relationship. A huge problem came to my mind when my wife told me that her ex did file the petition for their K-1 Visa. By the time they broke up they didn't send anything yet (they prepared everything, ready to send it out) and she thought he stopped filing the petition. And now, We are on the NVC process (sent I-864 and DS-230 to NVC already).

Of course on I-130, for beneficiary we filled out that she was not on any immigration process before (because we thought my wife's ex didn't want to send out petition for their K-1 Visa anymore). Now we are in deep trouble (look like we are lying on the petition). I have to mention one thing, he canceled their case already (their case was done with USCIS and was sent to NVC, and it stopped right here) because he just married and wanted to file Cr-1 Visa for his wife. (he married last year)

With this situation, what should I do then? We have been married for almost 2 years and have a daughter together who is a year old. :(

Print out the chat log and take it with you. I am assuming she said somewhere in there she didn't KNOW he filed it. Maybe try and find the phone records where she changed her phone number and proof from pay stubs she changed her job around that time too, so she can further show she did not contact him and the story is truthful?

Packet 3 paperwork mailed to Rob 6-12-10

Medical- July 8, 2010

Everything mailed to Embassy 7-19-10

Interview Date: 9-14-10- Approved pending non-machine washed replacement passport.

Entry to US- 10-6-10 POE- Newark

Wedding- 10-23-10

AOS

Mailed AOS paperwork to the Chicago lockbox 1-7-11

Delivery Notification 1-10-11

Text stating application was received 1-20-11

Check Cashed 1-21-11

NOA 1 received 1-22-11

Biometrics letter received 1-29--11

Biometrics appointment 2-24-11

Received notice- I-485 has been transferred to the California Service Center 2-9-11.

3-11-11 - EAD production ordered

After we get all these evidences, we just take to the interview? The problem is we did fill out in I-130 as no immigration process before. If CO ask her about that, then just show him/her the evidence that we have. Is this correct?

I would make absolutely sure first she was 100% totally unaware it was filed. If she and the ex-boyfriend both agree to that, then ask him to write a letter stating the same. Print out the chat logs and the evidence, and take it with you...I am not sure there is much more than that you CAN do.

I don't know for a fact that it's all you can do...perhaps there is someone here who has definitive knowledge on this.

Was she in USA at the time when her B/F filed for K-1 ? Because to me it sounds a bit confusive, as K-1 is a finace visa and to bring your fiance to usa and to get married ??

If she was in USA, why did he file K-1, instead of that he could have got married with her in the court and filed AOS (adjustment of status).

Please clear the confusion ...

Sorry I misunderstood a bit...........but as long as your I-130 has been approved and you are at NVC stage.......I am 100% sure your wife will go through this like a peace of cake.

I think sometimes thinking a bit positive won't hurt, and that's what I was doing. Giving him a boost. Time will tell whether he got peace of cake or peace in cake.

@All: I will tell my wife to collect all evidences and tell her to tell her ex to write a letter. Hopefully everything is going ok. :innocent:
