k1 and income

Hi everyone! if my fiance earns $37k a year and his ITR for 2005 only showed $24k (since he started working on his present job last june 2005) Will that be a problem? Considering we dont have other assets? we have the employer's letter, bank letter, bank statements and w2. Any advice would be highly appreciated.

P.S:

We don't have anyone to co-sponsor us.

I don't think it will be a problem, 24k, and 37k is both over the poverty guidelines.

I don't think they look at the tax returns so much as to say how much money you've been making, as to show a history of employment.

If he's making 37k now, and he has a letter from his empolyer stating that, everything should be fine.

Well .. from what the lawyer i talked to said you shouldn't have an issue here. If he has been making over the poverty guideline for your # of family members for over a year now ( june / 05 ) that should be good enough .. just a thought , you 'could' include some pay stubs to match the bank statements. Getting qualified for the I-129F is one thing. When you go through AOS don't you have to show more income verification? and 3 years tax returns? what are the standards then?

Hmm.. that's the problem. You see, my fiance lived here in the Philippines to study since nursery. He just left for the states last year after college. He went there to provide us a better future. His present job is his 2nd job, and he's doing good. He was promoted to manager in just 6 months and his boss always tell him how valuable he is for him and his company. Is my situation a problem when I adjust status?

I'm not 100% sure ... @ the start of all this ( before finding VJ ) we did in fact have the standards for AOS and I-129F confused :unsure: If i'm not mistaken they do require 3 years tax returns for AOS but the exact income standards for those 3 years i have no idea ... My Fiancee has met the poverty guidelines for a family our size for many years .. so we decided not to worry about the details. Some consulates require you to show 3 years of tax returns even for the K1 .. (Vancouver canada requires 3 years worth from my Fiancee) But i'm under the impression it's just to get a better idea of his history :yes:

what if we dont have that? do they send me back to my country?

You have to show 3 years of tax returns and be above 125% of the poverty guideline, as far as I know. You'll need to file an I-864 for AOS.

I wouldn't worry too much .. I'm not sure how they treat students. I know in the mortgage business the 2 year work history includes college. You might have to be working in the field you studied, I'm not sure. You might want to do some research into the requirements for AOS. But, you should be ok for the I-129F, just get here, get married, and cross that bridge when you get there.

You might have another tax return by then anyway!! you can wait it out a little bit before you come to the states, I believe it's 6 months to enter the US after visa approval (I think), then you have 90 days, then you have the AOS process. Prepare for it now, but don't get in a big worry! you'll be fine for the I-129F as far as I know!

ok, i'll just do it one step at a time. I need to go to the states asap when i (hopefully) receive the visa since it has been 1 year and 8 months we're apart now. We've agreed before he left for the states that he puts all his time in his work and be stable so we could be with each other sooner. i can't have him visit me because his vacation leave is still very short. So, help us God! By the way, my interview is 4 days from now. Eeecks! I am sooo nervous!!!
